SHAH APP for Respondent(s) :\n1, \n======================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH \n\t\t\t\n\t\t\t \n\nH.SHUKLA\n\t\t\n\t\n\n \n\nDate\n: 04\/10\/2010  \n \nORAL ORDER<\/pre>\n<p>The<br \/>\n\tpresent application has been filed by the applicant for grant of<br \/>\n\tregular bail under section 439 of Code of Criminal Procedure, 1973,<br \/>\n\tafter the charge sheet is filed.\n<\/p>\n<p>The<br \/>\n\tapplicant is charged with having committed offence sections 489(B),<br \/>\n\t(C) and section 34 of Indian Penal Code, for which, F.I.R. being<br \/>\n\tI-C.R.No.119 of 2009 has been registered with Amreli Taluka Police<br \/>\n\tStation.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr.Mangukia for the applicant accused referred to the First<br \/>\n\tInformation Report and submitted that considering the nature of<br \/>\n\toffence and the role attributed to the applicant and as now the<br \/>\n\tcharge sheet has been filed, present application may be allowed and<br \/>\n\tthe applicant may be released on bail.\n<\/p>\n<p>Learned<br \/>\n\tAdditional Public Prosecutor Ms.M.L.Shah resisted the application.\n<\/p>\n<p>Having<br \/>\n\theard Mr.Mangukia, learned advocate for the applicant and<br \/>\n\tMs.M.L.Shah, learned APP for State and having considered the nature<br \/>\n\tof offence, role attributed to the applicant and the fact that as<br \/>\n\tnow the charge sheet has been filed, present application deserves to<br \/>\n\tbe allowed.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with F.I.R. being<br \/>\n\tI-C.R.No.119 of 2009 registered with Amreli Taluka Police Station on<br \/>\n\this executing bond of Rs.5,000\/- (Rupees Five Thousand) with one<br \/>\n\tsolvent surety of the like amount to the satisfaction of the lower<br \/>\n\tCourt and subject to the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tmark<br \/>\nhis presence before concerned Police Station on 1st Monday<br \/>\nof English calender month between 11:00 AM to 2:00 PM till the trial<br \/>\ncommences.\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>\tRule<br \/>\n\tis made absolute to the aforesaid extent.
