Chief Justice)\n\n\n\n\n        Counsel for the petitioner and Regional Manager of the 4th  respondent- Bank\n\n\nare   present.     Mr.Aji   Kumar   who   is   the   son   of   the   petitioner   is   also   present\n\n\nrepresenting the petitioner.  After discussions the parties have settled their dispute in\n\n\nthe case, on the following terms:\n\n\n        `a.   The   amount   due   to   the   Bank   as   on   date   is   mutually   agreed   as\n\n\nRs.9,33,000\/-   (Rupees   Nine   lakhs   and   thirty   three   thousand   only).     Out   of     this\n\n\namount Rs.4,00,000\/- (Rupees Four Lakhs only) will be paid by the petitioner to the\n\n\n4th  respondent   on   or   before   21.12.2006   and   the   balance   in   2   equal   instalments\n\n\npayable on or before 15.1.2007 and 15.2.2007 respectively.\n\n\n        b.   Instalments due on  15.1.2007 and 15.2.2007  will  attract  interest  at 5.5%\n\n\nper annum with effect from this date.\n\n\n        c.   In   case   any   of   the   3   payments   afore-mentioned   are   defaulted,   the   4th\n\n\nrespondent will be free to proceed with the recovery proceedings already initiated.\n\n\n        The case is compromised  as stated above.\n\n\n\n\n\n                                                                                            M.M.PAREED PILLAY\n\n                                                                                          (RETD. Chief Justice)<\/p>\n<p>       Parties have settled their dispute as per the following terms:\n<\/p>\n<p>       a. The 3rd   Respondent bank agrees to accept a sum of Rs.2,80,000\/-\n<\/p>\n<p>(Rupees Two lakhs and eighty thousand only) in   full and final settlement of<\/p>\n<p>the  dues.\n<\/p>\n<p>       b. Out of the said amount, a sum of Rs.1,00,000\/- (Rupees One lakh<\/p>\n<p>only) will be paid by the petitioner on or before 31.12.2006 and the balance of<\/p>\n<p>Rs.1,80,000\/-(Rupees   One   lakh   eighty   thousand   only)   will   be   paid   in   two<\/p>\n<p>equal   instalments   on   or   before   31st  January   2007   and   28   February   2007<\/p>\n<p>respectively.   On payment of last of the above instalments, the Bank agrees<\/p>\n<p>to withdraw the criminal proceedings initiated against the petitioner in respect<\/p>\n<p>of dishonored cheque.\n<\/p>\n<p>       c.  As regards the  claim  raised  against  the  petitioner   and  Mohammed<\/p>\n<p>Abdu   Rahman   as   per   notice   issued   by  the   Bank&#8217;s   Advocate   on   5th  October<\/p>\n<p>2006,  the Bank agrees that the claim will not be pursued any further after the<\/p>\n<p><span class=\"hidden_text\">WP(C) NO.26274\/2006\/C                                          2<\/span><\/p>\n<p>payment   of   the   last   aforesaid   instalment.
