SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/04\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tBy<br \/>\n\tway of this petition under Article 226 of the Constitution of India,<br \/>\n\tthe petitioners have prayed for the following main relief in terms<br \/>\n\tof para 27(A) :-\n<\/p>\n<p>&#8220;27(A).\n<\/p>\n<p>This Honourable Court may be pleased to issue a writ of mandamus or<br \/>\nany other appropriate writ, order or direction directing the<br \/>\nrespondent Corporation to specify the area of the land allotted to<br \/>\nthe petitioners under T.P. Scheme No. 23 of Sabarmati, out of Final<br \/>\nPlot Nos.56 and 57, in lieu of the lands of the petitioners bearing<br \/>\nSurvey Nos.150 and 161\/3 of Village Acher, Taluka City, District :<br \/>\nAhmedabad and permit the petitioners to develop the said area in<br \/>\naccordance with the provisions of the Act and the Building<br \/>\nRegulations of the respondent Corporation, within a period as may be<br \/>\nspecified by the Honourable Court.&#8221;\n<\/p>\n<p>\tAfter<br \/>\n\tmaking some submissions, Mr.A.J. Patel, learned advocate does not<br \/>\n\tpress the present petition for the realief sought in para 27(A) by<br \/>\n\tsubmitting that the petitioners   propose to initiate independent<br \/>\n\tproceedings for appropriate relief directing the appropriate<br \/>\n\tauthority and the Corporation to  acquire the land in question for<br \/>\n\tBus Depot for Ahmedabad Municipal Transport Services (AMTS).\n<\/p>\n<p>\tUnder<br \/>\n\tthe circumstances, present petition is dismissed  as withdrawn so<br \/>\n\tfar as prayer in terms of para 27(A) with above liberty. As and<br \/>\n\twhen independent proceedings are initiated, the same shall be<br \/>\n\tconsidered in accordance with law and on merits, for which this<br \/>\n\tCourt has not expressed any opinion on merits.  Rule is discharge.<br \/>\n\tInterim relief granted earlier, if any, stands vacated forthwith.
