(J)\n\nCITATION:\n 1994 SCC  (5) 328\t  JT 1994 (5)\t432\n 1994 SCALE  (3)285\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>The Judgment of the Court was delivered by<br \/>\nKULDIP\tSINGH, J.- Chander Bhan Gill (Gill)  joined  Central<br \/>\nGovernment service on 25-1-1985.  The Central Civil Services<br \/>\n(Revised  Pay)\tRules, 1986 (the Rules) came into  force  on<br \/>\n1-1-1986.   On\tcompletion of one year&#8217;s  service  Gill\t was<br \/>\ngranted annual increment in the existing scale\t(unrevised).<br \/>\nHis  claim for grant of annual increment in the revised\t pay<br \/>\nscale  was rejected by the Government.\tGill challenged\t the<br \/>\naction of the Government by way of an application before the<br \/>\nCentral Administrative Tribunal, Principal Bench, New  Delhi<br \/>\n(the  Tribunal).  The Tribunal by its judgment\tdated  13-4-<br \/>\n1992  dismissed\t the application.  This appeal\tby  Gill  is<br \/>\nagainst the judgment of the Tribunal.\n<\/p>\n<p>2.   We\t may notice the necessary facts.  Gill was  selected<br \/>\nfor  appointment as Assistant (Legal) in the  Department  of<br \/>\nLegal  Affairs, Ministry of Law and Justice,  Government  of<br \/>\nIndia.\t He joined the Ministry as such on 25-1-1985 in\t the<br \/>\npay  scale  of\t425-15-500-EB-15-560-20-700-EB-25-800.\t One<br \/>\nS.S.  Dhaiya  was also selected and appointed  as  Assistant<br \/>\n(Legal) along with the appellant.  He joined service on 4-3-<br \/>\n1985 in the same pay scale.\n<\/p>\n<p>3.   The  existing  pay\t scale for  the\t post  of  Assistant<br \/>\n(Legal)\t (425-800)  was revised\t to  1640-60-2600-EB-75-2900<br \/>\nunder  the Rules with effect from 1-1-1986.  Gill  completed<br \/>\none  year&#8217;s service on 26-1-1986 and became entitled to\t the<br \/>\ngrant  of  an  annual increment.   The\tshort  question\t for<br \/>\nconsideration is whether he was entitled to the increment in<br \/>\nthe  revised scale of pay (Rs 60) or in the unrevised  scale<br \/>\n(Rs 15).\n<\/p>\n<p>4.   The  Government of India Instructions contained in\t the<br \/>\noffice memorandum dated 7-1-1971 are as under:\n<\/p>\n<blockquote><p>\t      &#8220;The  undersigned\t is  directed  to  invite  a<br \/>\n\t      reference\t on the recommendation of the  Third<br \/>\n\t      Pay Commission contained in para 29 of Chapter<br \/>\n\t      8\t in Volume I of their Report to\t the  effect<br \/>\n\t      that in future, an increment should be granted<br \/>\n\t      from  the 1st of the month in which  it  falls<br \/>\n\t      due  instead of from the actual date on  which<br \/>\n\t      it accrues, and to say that<br \/>\n<span class=\"hidden_text\">\t      330<\/span><br \/>\n\t      Government   have\t  accepted   the   aforesaid<br \/>\n\t      recommendation of the Commission vide Item No.<br \/>\n\t      5\t in the annexure appended to the  Resolution<br \/>\n\t      No. 70(34)-Imp.  Cell dated 1- 11- 1973.\t The<br \/>\n\t      sanction\tof  the\t President  is\t accordingly<br \/>\n\t      conveyed hereby to the increment of  employees<br \/>\n\t      being  admitted from the 1 St of the month  in<br \/>\n\t      which it would fall due under the operation of<br \/>\n\t      the   general  rules  and\t orders\t  regulating<br \/>\n\t      increments.\n<\/p><\/blockquote>\n<blockquote><p>\t      2.    These  orders shall take effect from  11<br \/>\n\t      1-   1973\t  and  shall  cover   only   Central<br \/>\n\t      Government  employees in Classes 11,  III\t and<br \/>\n\t      IV.&#8221;\n<\/p><\/blockquote>\n<p>5. The Government of India issued office memorandum dated 4-<br \/>\n5-1987\ti wherein various clarifications in respect  of\t the<br \/>\nRules were given.  The clarification at Serial No. 1 of\t the<br \/>\nmemorandum, which is relevant, is as under:\n<\/p>\n<p> &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<pre>     \"SI.\t   Points raised     Clarifications\n     No.\n<\/pre>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>    (1)\t\t\t(2)\t\t  (3)\n<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p>\n<blockquote><p>     1.\t  In case of a government    Increment in the Pre-<br \/>\n\t  servant whose increment    revised scale is to be<br \/>\n\t  accrued in the pre-revised allowed first on 1-1-<br \/>\n\t  scale on 1-1-1986, whether 1986 and pay fixed in<br \/>\n\t  the increment in the pre-  in the revised scale<br \/>\n\t  revised scale is to be allo-\ttherefore.<br \/>\n\t  wed first and pay fixed in<br \/>\n\t  the revised scale under CCS<br \/>\n\t  (RP) Rules 1986 latter or pay<br \/>\n\t  fixed in the revised scale<br \/>\n\t  first and increment allowed<br \/>\n\t  latter in the revised scale.&#8221;<\/p><\/blockquote>\n<p>     6.\t  The  appellant  completed one\t year&#8217;s\t service  on<br \/>\n26-1-1986  and\tas such an increment accrued to him  on\t the<br \/>\nsaid  date but keeping in view the  Government\tinstructions<br \/>\ndated  7-1-1971 he was to be given the increment  from\t1-1-<br \/>\n1986.\tRelying\t upon the clarification dated  4-5-1987\t the<br \/>\nGovernment  of India granted the increment to the  appellant<br \/>\nin  the\t pre-revised scale.  Rs 15 were added to  his  basic<br \/>\npre-revised pay of Rs 425 thereby making a total of Rs\t440.<br \/>\nAfter  doing the exercise of granting him increment  in\t the<br \/>\npre-revised scale he was given the revised pay scale and his<br \/>\nbasic pay on 1-1-1986 was fixed as Rs 1640.\n<\/p>\n<p>7.   It\t is not necessary for us to go into the question  as<br \/>\nto  whether the clarification dated 4-5-1987 is contrary  to<br \/>\nthe Rules.  The clarifications are, ordinarily, issued\twith<br \/>\na view to remove the anomalies in the working of the  Rules.<br \/>\nIn the facts of this case, however, the clarification has<br \/>\nrather\tcreated\t an  anomaly.\tWe  see\t no  logic  in\t the<br \/>\nclarification.\t It  is applicable only\t to  the  government<br \/>\nservants whose increment accrued on 1-1-1986.  All those who<br \/>\nearned the increment any time between 1-2-1986 to 31-12-1986<br \/>\nwere  given  the increment in the revised  scale.   Had\t the<br \/>\nappellant joined in the month of February 1985 or thereafter<br \/>\nhe  would have got the increment in the revised\t scale.\t  As<br \/>\nmentioned above S.S. Dhaiya was selected and appointed along<br \/>\nwith the appellant.  He joined on 4-3-1985 and was given his<br \/>\nannual\tincrement with effect from 1-3-1986 in\tthe  revised<br \/>\nscale.\tThe Government<br \/>\n<span class=\"hidden_text\">331<\/span><br \/>\naction\tbased  on  the\tclarification  dated  4-5-1987\t has<br \/>\nobviously worked to the detriment of the appellant.\n<\/p>\n<p>8.   We\t may examine the appellant&#8217;s claim under the  Rules.<br \/>\nRules 5, 6(3), 7 and 8 of the Rules, to the extent relevant,<br \/>\nare reproduced hereunder:\n<\/p>\n<blockquote><p>\t      &#8220;5.   Drawal  of pay in the  revised  scales.-<br \/>\n\t      Save  as otherwise provided in these rules,  a<br \/>\n\t      government  servant  shall  draw\tpay  in\t the<br \/>\n\t      revised scale applicable to the post to  which<br \/>\n\t      he is appointed:\n<\/p><\/blockquote>\n<blockquote><p>\t      Provided\tthat a government servant may  elect<br \/>\n\t      to continue to draw pay in the existing  scale<br \/>\n\t      until  the date on which he earns his next  or<br \/>\n\t      any subsequent increment in the existing scale<br \/>\n\t      or until he vacates his post or ceases to draw<br \/>\n\t      pay in that scale &#8230;.\n<\/p><\/blockquote>\n<blockquote><p>\t      6.    Exercise of option.-\n<\/p><\/blockquote>\n<p>(3)  If\t the  intimation regarding option  is  not  received<br \/>\nwithin\tthe time mentioned in sub-rule (1),  the  government<br \/>\nservant\t shall be deemed to have elected to be\tgoverned  by<br \/>\nthe revised scale of pay with effect on and from the 1st day<br \/>\nof January, 1986.\n<\/p>\n<p>7.   Fixation of initial pay in the revised scale.- (1)\t The<br \/>\ninitial pay of a government servant who elects, or is deemed<br \/>\nto have elected under sub-rule (3) of Rule 6 to be  governed<br \/>\nby  the\t revised scale on and from the 1st day\tof  January,<br \/>\n1986,  shall,  unless in any case the President\t by  special<br \/>\norder  otherwise directs, be fixed separately in respect  of<br \/>\nhis substantive pay in the permanent post on which he  holds<br \/>\na  lien\t or  would  have held a lien  if  it  had  not\tbeen<br \/>\nsuspended, and in respect of his pay in the officiating post<br \/>\nheld by him, in the following manner, namely-\n<\/p>\n<blockquote><p>\t      (A)   in the case of employees,-\n<\/p><\/blockquote>\n<blockquote><p>\t      (i)   an\tamount representing 20 per  cent  of<br \/>\n\t      the  basic pay in the existing scale,  subject<br \/>\n\t      to  a minimum of Rs 75, shall be added to\t the<br \/>\n\t      &#8216;existing emoluments&#8217; of the employee;\n<\/p><\/blockquote>\n<blockquote><p>\t      (ii)  after the existing emoluments have\tbeen<br \/>\n\t      so  increased,  the pay  shall  thereafter  be<br \/>\n\t      fixed  in the revised scale at the stage\tnext<br \/>\n\t      above the amount thus computed:<br \/>\n\t      Provided that,-\n<\/p><\/blockquote>\n<blockquote><p>\t      (a)   if\tthe minimum of the revised scale  is<br \/>\n\t      more  than the amount so arrived at,  the\t pay<br \/>\n\t      shall  be fixed at the minimum of the  revised<br \/>\n\t      scale;\n<\/p><\/blockquote>\n<blockquote><p>\t      (b)   if the amount so arrived at is more than<br \/>\n\t      the  maximum  of the revised  scale,  the\t pay<br \/>\n\t      shall be fixed at the maximum of that scale.\n<\/p><\/blockquote>\n<p>8.   Date of next increment in the revised scale.- The\tnext<br \/>\nincrement  of a government servant whose pay has been  fixed<br \/>\nin the revised scale in accordance with sub-rule (1) of Rule<br \/>\n7  shall  be  granted on the date he would  have  drawn\t his<br \/>\nincrement had he continued in the existing scale:\n<\/p>\n<p><span class=\"hidden_text\">332<\/span><\/p>\n<p>9.   It is not disputed that the appellant did not give\t any<br \/>\noption under Rule 5 of the Rules and as such under Rule 6(3)<br \/>\nhe became entitled to the revised scale of pay &#8220;with  effect<br \/>\non  and\t from  the 1st day of  January,\t 1986&#8221;.\t  Since\t the<br \/>\nminimum of the revised scale of the appellant was more\tthan<br \/>\nthe  amount worked out under Rule 7(1)(A)(i)(ii)  he  became<br \/>\nentitled under Rule 7(1)(A)(a) to be fixed at the minimum of<br \/>\nthe revised scale.  It is clear from the combined reading of<br \/>\nRules  6 and 7 of the Rules that the appellant was  entitled<br \/>\nto  be\tfixed at Rs 1640 as his basic pay with\teffect\tfrom<br \/>\n1-1-1986 in the revised scale.\tThe pre-revised scale ceased<br \/>\nto operate on 31-12-1985.  Rule 8 of the Rules clearly\tlays<br \/>\ndown that &#8220;the next increment of a government servant  whose<br \/>\npay  has been fixed in the revised scale in accordance\twith<br \/>\nsub-rule (1) of Rule 7 shall be granted on the date he would<br \/>\nhave  drawn his increment, had he continued in the  existing<br \/>\nscale&#8221;.\t  The language of the rule makes it clear  that\t the<br \/>\nappellant,  whose annual increment became due  on  1-1-1986,<br \/>\nwas  entitled  to  the grant of the said  increment  in\t the<br \/>\nrevised pay scale.  We are, therefore, of the view that\t the<br \/>\nappellant-Gill\twas  entitled  to  the grant  of  Rs  60  as<br \/>\nincrement with effect from 1-1-1986 and his basic pay in the<br \/>\nrevised\t scale\tshould have been fixed at Rs 1700  from\t 11-<br \/>\n1986.\n<\/p>\n<p>10.  We\t allow the appeal and set aside the judgment of\t the<br \/>\nTribunal.  We allow the application filed by Gill before the<br \/>\nTribunal  in the above terms.  We direct the respondents  to<br \/>\nfix the pay of the appellant as Rs 1700 with effect from  11\n<\/p>\n<p>&#8211;  1986 and give him all the consequential  benefits.\tThis<br \/>\nshould\tbe  done within three months from the  date  of\t the<br \/>\nreceipt\t of this judgment.
