No.211 of 2009\n                     -------------------------------------\n             Dated this the 15th day of January, 2009\n\n                                  ORDER\n<\/pre>\n<p>      Petitioner faces indictment in a prosecution for offences<\/p>\n<p>punishable, inter alia, under Sections 326 and 308 r\/w 34 I.P.C.<\/p>\n<p>The petitioner was arrested and enlarged on bail. Final report<\/p>\n<p>was filed. Cognizance was taken. Committal proceedings was<\/p>\n<p>registered. The petitioner had appeared before the committal<\/p>\n<p>court also and was enlarged on bail.                     At that juncture, the<\/p>\n<p>petitioner secured employment and the compulsions of his<\/p>\n<p>employment compelled him to remain in the country of his<\/p>\n<p>employment. He was not hence able to return and participate in<\/p>\n<p>the proceedings. The case against the petitioner has now been<\/p>\n<p>split up.   Coercive processes have been issued against the<\/p>\n<p>petitioner.   The petitioner apprehends imminent arrest in<\/p>\n<p>execution of such processes.\n<\/p>\n<p>      2.    According to the petitioner he is absolutely innocent.<\/p>\n<p>His absence was not wilful or deliberate. He is suffering from<\/p>\n<p>ailments. He is returning from his place of employment to India<\/p>\n<p>to get the necessary treatment. He is expected to be in India<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No.211 of 2009          2<\/span><\/p>\n<p>shortly. The petitioner is willing to surrender before the learned<\/p>\n<p>Magistrate and seek regular bail. But he apprehends that his<\/p>\n<p>application for regular bail may not be considered by the learned<\/p>\n<p>Magistrate on merits, in accordance with law and expeditiously.<\/p>\n<p>It is therefore prayed that directions under Section 482 Cr.P.C<\/p>\n<p>may be issued in favour of the petitioner.\n<\/p>\n<p>      3.   It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate    and   explain   to  the   learned    Magistrate   the<\/p>\n<p>circumstances under which he could not earlier appear before<\/p>\n<p>the learned Magistrate. I have no reason to assume that the<\/p>\n<p>learned Magistrate would not consider such application on<\/p>\n<p>merits, in accordance with law and expeditiously. Every court<\/p>\n<p>must do the same. No special or specific direction appears to be<\/p>\n<p>necessary.    Sufficient general directions have already been<\/p>\n<p>issued in <a href=\"\/doc\/1851848\/\">Alice George v. The Deputy Superintendent of<\/p>\n<p>Police<\/a> [2003(1) KLT 339].\n<\/p>\n<p>      4.   This Crl.M.C is, in these circumstances, dismissed, but<\/p>\n<p>with the specific observation that if the petitioner appears before<\/p>\n<p>the learned Magistrate and applies for bail after giving sufficient<\/p>\n<p>prior notice to the Prosecutor in charge of the case, the learned<\/p>\n<p>Magistrate must proceed to pass appropriate orders on merits, in<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No.211 of 2009         3<\/span><\/p>\n<p>accordance with law and expeditiously &#8211; on the date of surrender<\/p>\n<p>itself.\n<\/p>\n<p>      5.   The learned counsel for the petitioner submits that<\/p>\n<p>the petitioner has ailments. The petitioner can bring that fact to<\/p>\n<p>the notice of the learned Magistrate and the learned Magistrate<\/p>\n<p>shall pass appropriate orders in the bail application to be filed by<\/p>\n<p>the petitioner taking note of all the relevant circumstances<\/p>\n<p>including the ailments of the petitioner.\n<\/p>\n<p>      6.
