SANKARAN, J.\n                    ---------------------------\n                     B.A. No.504 of 2010\n                  -------------------------------\n             Dated this the 15th day of March, 2010\n\n                           O R D E R\n<\/pre>\n<p>    When the Bail Application came up for hearing on<\/p>\n<p>25\/02\/2010, the following order was passed;<\/p>\n<blockquote><p>          &#8220;This is an application for anticipatory bail<\/p>\n<p>    under Section 438 of the Code of Criminal<\/p>\n<p>    Procedure. The petitioner is accused No.5 in Crime<\/p>\n<p>    No.2\/2007 of Bediyaduka Police Station, Kannur.<\/p>\n<\/blockquote>\n<blockquote><p>          2.   The    offences    alleged    against   the<\/p>\n<p>    petitioner are under Sections 419, 468, 109 and 166<\/p>\n<p>    read with Section 34 of the Indian Penal Code and<\/p>\n<p>    Section 12(1)(b) of the Passport Act.<\/p>\n<\/blockquote>\n<blockquote><p>          3.   The gist of the prosecution case is the<\/p>\n<p>    following: The de facto complainant approached<\/p>\n<p>    accused Nos. 1 and 2 to get a passport. Accused<\/p>\n<p>    Nos. 1 and 2 were conducting a Travel Agency.<\/p>\n<p>    They collected money from the de facto complainant<\/p>\n<p>    towards expenses and also for police verification.<\/p><\/blockquote>\n<p>    Accused No.3 is a police constable. It is alleged that<\/p>\n<p>    he also received money for police verification. Later,<\/p>\n<p>    it is stated that the documents belonging to the de<\/p>\n<p>    facto complainant were returned to him stating that<\/p>\n<p>    there was a raid in the Travel Agency and therefore<\/p>\n<p>    accused Nos.1 and 2 could not make arrangements<\/p>\n<p>B.A. No.504\/2010<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>      for getting passport. The de facto complainant later<\/p>\n<p>      applied for passport. In that application, he stated<\/p>\n<p>      that he was not a holder of Indian passport and that<\/p>\n<p>      he had not applied for passport earlier. On<\/p>\n<p>      verification, the passport authorities found that<\/p>\n<p>      another passport had already been issued to the de<\/p>\n<p>      facto complainant. On verification, it was found that<\/p>\n<p>      the passport was issued in the name of the de facto<\/p>\n<p>      complainant with slight different address and that<\/p>\n<p>      this was done at the instance of accused Nos.1 and<\/p>\n<p>      2. It is alleged that the petitioner was in charge of<\/p>\n<p>      the Passport Verification Section at the relevant<\/p>\n<p>      time. It is submitted that there is no allegation that<\/p>\n<p>      the    petitioner  was   directly  involved  in   any<\/p>\n<p>      manipulation or in any fraud. The petitioner is<\/p>\n<p>      implicated in the case, according to the learned<\/p>\n<p>      counsel for the petitioner, only on the ground that<\/p>\n<p>      he was in charge of the Passport Verification Section<\/p>\n<p>      at the relevant time.\n<\/p>\n<p>            4.     After having heard the learned counsel<\/p>\n<p>      for the petitioner and the learned Public Prosecutor,<\/p>\n<p>      I am of the view that before disposing of the Bail<\/p>\n<p>      Application, an opportunity should be given to the<\/p>\n<p>      petitioner to appear before the investigating officer.<\/p>\n<p>      Accordingly, there will be a direction to the<\/p>\n<p>B.A. No.504\/2010<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>      petitioner to appear before the investigating officer<\/p>\n<p>      at 9 A.M. on 6th and 7th March, 2010.\n<\/p>\n<p>            5.   Post on 15\/03\/2010.\n<\/p>\n<p>            6.   It is submitted by the learned Public<\/p>\n<p>      Prosecutor that the petitioner will not be arrested<\/p>\n<p>      until further orders in connection with Crime No. 2<\/p>\n<p>      of 2007 of Bediyaduka Police Station, Kannur.<\/p>\n<p>            The petitioner shall produce a copy of this<\/p>\n<p>      order before the investigating officer.&#8221;<\/p>\n<p>      2.    It is submitted by the learned counsel for the<\/p>\n<p>petitioner as well as the learned Public Prosecutor that the<\/p>\n<p>petitioner has complied with the direction contained in the order<\/p>\n<p>dated 25\/02\/2010.\n<\/p>\n<p>      3.    Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p>the view that anticipatory bail can be granted to the petitioner.<\/p>\n<p>There will be a direction that in the event of the arrest of the<\/p>\n<p>petitioner, the officer in charge of the police station shall release<\/p>\n<p>him on bail on his executing bond for Rs.15,000\/- with two<\/p>\n<p>solvent sureties for the like amount to the satisfaction of the<\/p>\n<p>officer concerned, subject to the following conditions:<\/p>\n<p>B.A. No.504\/2010<br \/>\n<span class=\"hidden_text\">                                   4<\/span><\/p>\n<p>         A) The petitioner shall        report    before      the<br \/>\n             investigating officer between 9 A.M and 11 A.M.<br \/>\n             on alternate Sundays, till the final report is filed<br \/>\n             or until further orders;\n<\/p>\n<p>         B) The     petitioner   shall   appear    before     the<br \/>\n             investigating officer for interrogation as and<br \/>\n             when required;\n<\/p>\n<p>         C) The petitioner shall not try to influence the<br \/>\n             prosecution    witnesses or    tamper     with   the<br \/>\n             evidence;\n<\/p>\n<p>         D) The petitioner shall not commit any offence or<br \/>\n             indulge in any prejudicial activity while on bail;<\/p>\n<p>         E) In case of breach of any of the conditions<br \/>\n             mentioned above, the bail shall be liable to be<br \/>\n             cancelled.\n<\/p>\n<p>       The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                      K.T.
