Pathan for the petitioners, learned AGP<br \/>\n\tShri Hukamsingh for respondents Nos. 1 to 3 and learned advocate<br \/>\n\tShri Buch for respondent No.4 on caveat.\n<\/p>\n<p>The<br \/>\n\tpetitioners&#8217; challenge an order dated 15.1.2008 passed by Deputy<br \/>\n\tCollector, Valsad by which he was pleased to uphold an order dated<br \/>\n\t30.9.2005 passed by Mamlatdar, Kaprada. Issue pertains to right of<br \/>\n\tway asserted by respondent No.4 to reach to his field through the<br \/>\n\tfield of the petitioners. Respondent No.4 holds Survey No. 157 of<br \/>\n\tvillage Ozar. They contend that through the agricultural field of<br \/>\n\tthe petitioners bearing survey No.19, they have been enjoying right<br \/>\n\tof way since long. Since the petitioners are obstructing their right<br \/>\n\tof way,  respondent No.4 had approached the Mamlatdar under Section<br \/>\n\t5 of the Mamlatdar Courts Act. Mamlatdar in above-mentioned order<br \/>\n\tgranted relief to respondent No.4 which aggrieved the present<br \/>\n\tpetitioners.\n<\/p>\n<p>In<br \/>\n\tthe earlier round of litigation, Deputy Collector had held in favour<br \/>\n\tof respondent No.4 upon which the petitioners had approached this<br \/>\n\tCourt by filing Special Civil Application No.22768\/2006. Learned<br \/>\n\tSingle Judge of this Court in order dated 15.1.2007, finding that<br \/>\n\torder of Deputy Collector is not a reasoned order,  remanded the<br \/>\n\tproceedings to the Deputy Collector. In the second round, Deputy<br \/>\n\tCollector passed his impugned order dated 15.1.2008 and once again<br \/>\n\tconfirmed the order of Mamlatdar.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Shri L.R. Pathan for the petitioners is perhaps justified<br \/>\n\tin pointing out that even the present order of Deputy Collector<br \/>\n\tthough apparently run into 10 pages, it is not elaborately giving<br \/>\n\treasons nor considers detailed submissions made by both the sides.<br \/>\n\tHowever, it may be noted that earlier also between the Mamlatdar and<br \/>\n\tDeputy Collector, proceedings were remanded and as noted High Court<br \/>\n\talso once remanded the proceedings before the Deputy Collector. In<br \/>\n\tthat view of the matter, I do not find it appropriate to toss the<br \/>\n\tproceedings from one place to another only to achieve the purpose of<br \/>\n\teliciting or extracting reasons from the Deputy Collector. I have<br \/>\n\ttherefore, heard the parties on merits of the matter also.\n<\/p>\n<p>I<br \/>\n\tfind that Mamlatdar had come to factual finding that respondent No.4<br \/>\n\thas a right of way through the field of the petitioner to reach his<br \/>\n\town agricultural land. Learned advocate for the petitioner was<br \/>\n\tunable to point out that field of respondent No.4 abuts on any<br \/>\n\tpublic road. He contended that field of respondent No.4 is<br \/>\n\tlandlocked and that respondent No.4 would have to pass through<br \/>\n\tagricultural filed of someone or other to access his land.<br \/>\n\tApparently, accessing through the filed of the petitioners, is the<br \/>\n\tshortest route to the village road. On this ground and on the ground<br \/>\n\tthat Mamlatdar and Deputy Collector had come to factual findings<br \/>\n\twhich do not call for interference in writ jurisdiction, I see no<br \/>\n\treason to interfere. Though Deputy Collector&#8217;s order is not<br \/>\n\telaborate in terms he has upheld the findings of the Mamlatdar in<br \/>\n\tthis regard. It may be recalled that proceedings under Section 5 of<br \/>\n\tthe Mamlatdar Courts Act are of summary nature and are meant to<br \/>\n\tsummarily remove obstructions in agriculturist accessing his field<br \/>\n\tthrough conventionally used passage from the field of others. If the<br \/>\n\tpetitioners have any grievance they can always establish their right<br \/>\n\tthrough detailed civil proceedings.\n<\/p>\n<p>Writ<br \/>\n\tpetition is therefore, not entertained.
