GOVERNMENT PLEADER for\nRespondent(s) : 1, 3, \nRULE SERVED BY DS for Respondent(s) : 1 -\n2. \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.C.UPADHYAYA\n\t\t\n\t\n\n \n\nDate\n: 25\/10\/2010\n \n\nORAL\nJUDGMENT<\/pre>\n<p>The<br \/>\n\tpetitioner-Harish Shankarbhai Trivedi filed the present petition<br \/>\n\tunder Article 226  of the Constitution of India, challenging the<br \/>\n\tdetention of his uncle-detenu Pravin alias Bakul Pranlal Mehta<br \/>\n\tpursuant to the detention order dated 03rd July, 2010,<br \/>\n\twhich was executed on 15th July, 2010, passed by the<br \/>\n\trespondent Police Commissioner, Rajkot City, by exercising the<br \/>\n\tpowers conferred under sub-section (2) of Section 3 of the Gujarat<br \/>\n\tPrevention of Anti Social Activities Act, 1985 ( PASA Act , for<br \/>\n\tshort). The detenu is  branded as  bootlegger .\n<\/p>\n<p>Heard<br \/>\n\tMr.Amrish K. Pandya, learned Advocate for the petitioner and Mr.L.B.<br \/>\n\tDabhi, learned Assistant Government Pleader for the respondents.\n<\/p>\n<p>The<br \/>\n\tdetenu came to be detained as  bootlegger  on his involvement in<br \/>\n\tone offence arising under the Bombay Prohibition Act.\n<\/p>\n<p>It<br \/>\n\thas been submitted by the learned counsel for the petitioner that it<br \/>\n\tis a settled legal position that on registration of one offence, no<br \/>\n\torder of detention could have been passed, as the detenu cannot be<br \/>\n\tbranded as  bootlegger . It has been further submitted that the<br \/>\n\tactivities of the detenu cannot be said to be injurious to the<br \/>\n\tpublic health or public order. It has been further submitted by the<br \/>\n\tlearned counsel for the petitioner that there is gross delay in<br \/>\n\tpassing the order of detention as well as gross delay in executing<br \/>\n\tthe order of detention.\n<\/p>\n<p>Per<br \/>\n\tcontra, Mr.L.B. Dabhi, learned Assistant Government Pleader<br \/>\n\trepresenting the respondents supported the detention order dated<br \/>\n\t03rd July, 2010 passed by respondent Commissioner of<br \/>\n\tPolice, Rajkot City and submitted that before passing the detention<br \/>\n\torder, the detention authority took into consideration all the<br \/>\n\trelevant papers and after subjective satisfaction, the detention<br \/>\n\torder is passed and thus the detention order is legal and proper and<br \/>\n\tno interference in the said order is warranted and consequently the<br \/>\n\tpetition deserves dismissal.\n<\/p>\n<p>I<br \/>\n\thave gone through the grounds of detention and considered the<br \/>\n\tsubmissions advanced on behalf of both the sides.\n<\/p>\n<p>The<br \/>\n\tCourt is of the opinion that there is much substance in the<br \/>\n\targuments advanced by learned counsel for the petitioner. It is seen<br \/>\n\tfrom the grounds that a general statement has been made by the<br \/>\n\tdetaining authority that consuming liquor is injurious to health. In<br \/>\n\tfact, a perusal of the order passed by the detaining authority shows<br \/>\n\tthat the grounds which are mentioned in the order are in reference<br \/>\n\tto the situation of  law and order  and not  public order .<br \/>\n\tTherefore, on this ground, the subjective satisfaction of the<br \/>\n\tdetaining authority is vitiated on account of non-application of<br \/>\n\tmind and the impugned order, therefore, deserves to be quashed and<br \/>\n\tset aside.\n<\/p>\n<p>Except<br \/>\n\tthe general statement, there is no material on record which shows<br \/>\n\tthat the detenu is carrying on illegal activities of selling liquor<br \/>\n\tor is engaged in such activity, which is harmful to the health of<br \/>\n\tthe public. In the case of ASHOKBHAI JIVRAJ @ JIVABHAI SOLANKI<br \/>\n\tv\/s. POLICE COMMISSIONER, Surat, reported in 2001 (1) GLH 393,<br \/>\n\thaving considered the decision of the Hon&#8217;ble Apex Court in the case<br \/>\n\tof Ram manohar Lohia v\/s. State of Bihar, reported in AIR<br \/>\n\t1966 SC 740, this Court held that the cases wherein the<br \/>\n\tdetention orders are passed on the basis of the statements of such<br \/>\n\twitnesses fall under the maintenance of  law and order  and not<br \/>\n\t public Order .\n<\/p>\n<p>Applying<br \/>\n\tthe ratio of the above decisions, it is clear that before passing an<br \/>\n\torder of detention, the detaining authority must come to a definite<br \/>\n\tfindings that there is threat to the &#8216;public order&#8217; and it is very<br \/>\n\tclear that the present case would not fall within the category of<br \/>\n\tthreat to a public order. In that view of the matter, when the order<br \/>\n\tof detention has been passed by the detaining authority without<br \/>\n\thaving adequate grounds for passing the said order, cannot be<br \/>\n\tsustained and, therefore, it deserves to be quashed and set aside.\n<\/p>\n<p>\tIn<br \/>\n\tthe result, this petition is allowed. The<br \/>\n\timpugned order of detention dated 03rd<br \/>\n\tJuly, 2010 passed by the respondent-Commissioner of Police, Rajkot<br \/>\n\tCity, is hereby quashed and set aside. The detenu-Pravin alias Bakul<br \/>\n\tPranlal Mehta is ordered to be set at liberty forthwith, if not<br \/>\n\trequired in any other case.
