No.5872\/2010.\n<\/p>\n<p>                              Heard the learned Advocates.\n<\/p>\n<p>                              This Appeal preferred under Clause 10 of the<br \/>\n                   Letters Patent arises from the judgment and order dated<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>06.05.2010 passed by the learned single Judge in the above<br \/>\nCWJC No. 12911 of 2007. Appellant before us is the<br \/>\nrespondent no. 7.\n<\/p>\n<p>          Pursuant to the removal of the writ petitioner<br \/>\nSunita Kumari as Angan Bari Sevika of Village Rasalpur<br \/>\nMahugain, District Gaya, the appellant was appointed as<br \/>\nAngan Bari Sevika. Removal of the writ petitioner as<br \/>\nAngan Bari Sevika has been set aside by the learned single<br \/>\nJudge on the ground of violation of principle of natural<br \/>\njustice. It is not in dispute that the writ petitioner had not<br \/>\nbeen given notice to show cause against the proposed<br \/>\nremoval. It cannot be gainsaid that the order of removal<br \/>\ndated 22.08.2007 was made in violation of principle of<br \/>\nnatural justice. The order of the learned single Judge in<br \/>\nthat regard does not warrant interference.\n<\/p>\n<p>          The second issue raised in the present Appeal is<br \/>\nthat the direction of the learned single Judge to set aside<br \/>\nClause 3 (Anga) of the Government Guidelines 2006<br \/>\nissued in respect of appointment of Angan Bari Sevika has<br \/>\nbeen set aside as violative of Articles 14 and 16 of the<br \/>\nConstitution. The very issue has been raised by the State<br \/>\nGovernment in Letters Patent Appeal No. 1439 of 2010<br \/>\narising from the impugned judgment and order dated<br \/>\n06.05.2010. The issue shall be dealt with in the said Letters<br \/>\nPatent Appeal No. 1439 of 2010.\n<\/p>\n<p>          Subject to the decision that may be taken in LPA<br \/>\nNo. 1439 of 2010 in respect of validity of Clause 3(Anga)<br \/>\nof the aforesaid Guidelines of 2006, this Appeal is<br \/>\ndismissed in limene.\n<\/p>\n<p><span class=\"hidden_text\">                          3<\/span><\/p>\n<p>                 Interlocutory Application No. 5872 of 2010<br \/>\n        stands disposed of.\n<\/p>\n<p>                              ( R.M.
