Justice R.BASANT\n\n Dated :24\/07\/2007\n\n O R D E R\n<\/pre>\n<p>                                     R.BASANT, J<\/p>\n<p>                          = = = = = = = = = = = = =<\/p>\n<p>                               B.A.No.4561  of 2007<\/p>\n<p>                        = = = = = = = = = = = = = =<\/p>\n<p>                       Dated this the 24th day of July, 2007<\/p>\n<p>       Application for regular bail.  Petitioners are accused 1 to 3 and 7<\/p>\n<p>to   13   in   a   crime   registered   under   Sections   395   and   153A   IPC.     The<\/p>\n<p>crux   of   the   allegations   against   the   petitioners   is   that   they   assaulted<\/p>\n<p>two friends belonging to opposite sex, who were found in Pazhasi Dam<\/p>\n<p>site.     There   is   allegation   that   the   said   friends   do   belong   to   different<\/p>\n<p>communities  and  on  account   of  that   reason  an   unlawful   assembly  of<\/p>\n<p>persons   including   the   petitioners   assaulted   the   said   friends   and<\/p>\n<p>committed   robbery   of   property   kept   by   them.     The   petitioners<\/p>\n<p>surrendered on various dates between 29.5.07 and 5.6.07.   Some of<\/p>\n<p>the   co-accused   have   already   been   granted   regular   bail   as   per   order<\/p>\n<p>dated 10.07.07 in B.A.No.4129\/2007 subject to conditions.<\/p>\n<p>       2.     The   learned   counsel   for   the   petitioners   prays,   the   learned<\/p>\n<p>Public   Prosecutor   does   not   raise   any   serious   objection   and   I   am<\/p>\n<p>satisfied that the petitioners  herein can also be released  on bail now<\/p>\n<p>subject to appropriate conditions.\n<\/p>\n<\/p>\n<p>       3.      In   the   result,   this   application   is   allowed.     The   petitioners<\/p>\n<p>shall be released on bail on the following terms and conditions.<\/p>\n<p><span class=\"hidden_text\">B.A.No.4561 of 2007                     2<\/span><\/p>\n<p>      i)     The   petitioners   shall   execute   bonds   for   Rs.50,000\/-<\/p>\n<p>(Rupees   fifty  thousand  only)  each  with  two   solvent   sureties   each  for<\/p>\n<p>the like sum to the satisfaction of the learned Magistrate;<\/p>\n<p>      ii)    The   petitioners   shall   make   themselves   available   for<\/p>\n<p>interrogation   before   the   Investigating   Officer   on   all   Mondays   and<\/p>\n<p>Fridays between 10 a.m and 12 noon for a period of three months and<\/p>\n<p>thereafter as and when directed by the Investigating Officer in writing<\/p>\n<p>to do so.\n<\/p>\n<\/p>\n<p>                                                        (R.BASANT, JUDGE)<\/p>\n<p>sj<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Rayess M.A vs State Of Kerala on 24 July, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 4561 of 2007() 1.
