1.Petitioner is an employee of the KSRTC. He was<\/p>\n
 placed under suspension. Later, memo of charges<\/p>\n
 was issued to him. The proceedings commenced,<\/p>\n
 allegedly,   on   the  basis    of   an   anonymous<\/p>\n
 complaint. Since further proceedings are pending<\/p>\n
 before the employer, I do not propose to record<\/p>\n
 the   details  of  the   allegations  against  the<\/p>\n
 petitioner. Suffice to say that the contention of<\/p>\n
 the petitioner is that the allegations in the<\/p>\n
 anonymous complaint are not sustained in the<\/p>\n
 preliminary enquiry wherein a different set of<\/p>\n
 allegations   has  cropped   up   leading  to  the<\/p>\n
 issuance of the memo of charges. He further<\/p>\n
 states that though the last sentence of the memo<\/p>\n
 of charges essentially concludes on the guilt and<\/p>\n
 there would be no purpose in further conducting<\/p>\n

 an enquiry, the preliminary enquiry is allegedly<\/p>\n
 conducted    by  a  person,   in   rank,  below the<\/p>\n
 petitioner. It is also contended that the entire<\/p>\n
 exercise is mere victimization and is a biased<\/p>\n
 procedure on account of the petitioner being a<\/p>\n
 member of the INTUC. He further states that he<\/p>\n
 and his wife are an inter-caste couple and are<\/p>\n
 entitled to protection from being transferred<\/p>\n
 out. The petitioner has been re-admitted to duty.<\/p>\n
 Though     he was  at  Palakkad    at  the  time of<\/p>\n
 suspension,    on   re-admission,    he   has   been<\/p>\n
 transferred to Thalassery. Petitioner challenges<\/p>\n
 such transfer also.\n<\/p>\n<\/p>\n
2.In so far as service in KSRTC is concerned, apart<\/p>\n
 from     the disciplinary    proceedings  which are<\/p>\n
 provided    in  the normal    course,  there  is  an<\/p>\n
 Appellate Tribunal presided by a District Judge<\/p>\n
 to hear appeals from final orders in disciplinary<\/p>\n
 matters.     The    initiation     of   disciplinary<\/p>\n
 proceedings cannot, now, be treated as wholly<\/p>\n
 groundless    or  in total    lack  of  jurisdiction<\/p>\n

 requiring the writ court to interfere on any<\/p>\n
 ground of injustice. The petitioner has adequate<\/p>\n
 remedy      even after    the  conclusion of  the<\/p>\n
 disciplinary proceedings. All such issues are<\/p>\n
 left open.\n<\/p>\n<\/p>\n
3.All that may gain some attention is the transfer<\/p>\n
 of the petitioner from Palakkad to Thalassery.<\/p>\n
 Though the petitioner may, as the servant of<\/p>\n
 KSRTC, have free transport in the buses, to the<\/p>\n
 extent permitted, the impugned order of transfer<\/p>\n
 reflects that it is issued as a consequence of<\/p>\n
 the    re-admission of    the petitioner to duty,<\/p>\n
 re-calling the order of suspension. If that were<\/p>\n
 so, the order of transfer should have been guided<\/p>\n
 only by the principle that the petitioner should<\/p>\n
 not be permitted to meddle with the evidence and<\/p>\n
 could be kept away from the scene of the situs of<\/p>\n
 the enquiry so that he may not influence probable<\/p>\n
 witnesses. In that view of the matter, I deem it<\/p>\n
 necessary that the competent authority takes a<\/p>\n
 second look on the question whether he should be<\/p>\n

 transferred out to Thalassery or could be posted<\/p>\n
 in a station nearer to Palakkad where his wife<\/p>\n
 works.\n<\/p>\n
 For the aforesaid reasons, while refusing to<\/p>\n
 interfere with the disciplinary proceedings and<\/p>\n
 preserving all the contentions of the petitioner<\/p>\n
 in    that   regard, to    be agitated before  the<\/p>\n
 appropriate authority at the appropriate time,<\/p>\n
 this writ petition is ordered directing that if<\/p>\n
 the petitioner moves the Managing Director of<\/p>\n
 KSRTC by appropriate representation complaining<\/p>\n
 about his transfer to Thalassery, that will be<\/p>\n
 considered sympathetically and in accordance with<\/p>\n
 law, having regard to the totality of the facts<\/p>\n
 and circumstances. Let this be done within a<\/p>\n
 period of one month from the receipt of such<\/p>\n
 representation. All other issues are left open.<\/p>\n
