In support of his<br \/>\n\tsubmission, he has referred to and relied upon the judgment of this<br \/>\n\tCourt in case of Urvashiben Kanubhai Joshi Wd\/o Kanubhai K. Joshi<br \/>\n\tV\/s Bakshisinh Ishwarsinh reported in 2009 (2) GLR 1078<br \/>\n\tand submitted that if the Suit seeking eviction under Section<br \/>\n\t12(3)(a) of the Rent Act is not considered then the Court is bound<br \/>\n\tto consider the question whether the case would fall under Section<br \/>\n\t12(3)(b) of the Rent Act. He, therefore, submitted that the present<br \/>\n\tapplication may be allowed.\n<\/p>\n<p>Learned<br \/>\n\tcounsel Mr.Sharma submitted that as observed by the lower Appellate<br \/>\n\tCourt, the amount of rent due was paid after the notice was served<br \/>\n\tand, therefore, it has been observed in Para No.19 of the judgment<br \/>\n\tthat the rent of Rs.942\/-, was accepted with protest. Therefore, the<br \/>\n\tconcurrent findings of facts arrived at by both the Courts below may<br \/>\n\tnot disturbed.\n<\/p>\n<p>Learned<br \/>\n\tcounsel, Mr.Vasavada, however, submitted that as per the<br \/>\n\tobservations made in the judgment reported in 2009 (2) GLR 1078,<br \/>\n\tthis aspect may be directed to be reconsidered afresh under Section<br \/>\n\t12(3)(a) of the Rent Act with a direction that if he fails to comply<br \/>\n\twith the direction and pay rent then, the decree may be passed.\n<\/p>\n<p>In<br \/>\n\tview of the rival submissions, it is required to be considered<br \/>\n\twhether the present application can be entertained or not.\n<\/p>\n<p>The<br \/>\n\tdecree for eviction on the ground of arrears of rent has not been<br \/>\n\tpassed and the Suit has been dismissed. Thereafter, the Appeal<br \/>\n\tpreferred by the applicant-plaintiff has also been dismissed and,<br \/>\n\ttherefore, the present Revision Application has been filed.\n<\/p>\n<p>In<br \/>\n\tlight of the discussions made in the judgment of the lower Appellate<br \/>\n\tCourt, the Court is of the opinion that it does not call for any<br \/>\n\tinterference. In fact, the provisions of Section 12(3)(b) is couched<br \/>\n\tin a language that &#8220;no decree for eviction shall be passed in<br \/>\n\tany such suit if, the first day of hearing of the suit or on or<br \/>\n\tbefore such other date as the Court may fix, the tenant pays or<br \/>\n\ttenders in Court the standard rent and permitted increases&#8221;.\n<\/p>\n<p>Therefore,<br \/>\n\thaving regard to the provisions of the Rent Act and underline object<br \/>\n\tof the Rent Act, which is beneficiary legislature, both the Courts<br \/>\n\tbelow have given concurrent findings of fact, which does not call<br \/>\n\tfor any interference.\n<\/p>\n<p>It<br \/>\n\tis well settled that the scope of Revision Application is even<br \/>\n\totherwise very limited even though the Revision is under Section<br \/>\n\t29(2) of the Rent Act.\n<\/p>\n<p>A<br \/>\n\tuseful reference can be made to the observation made by the Hon&#8217;ble<br \/>\n\tApex Court in a judgment reported in AIR 2008 SC 2607 in case<br \/>\n\tof Yunis Ali (Dead) Thru his L. Rs. V\/s Khursheed Akram,<br \/>\n\twherein it has been observed referring to the scope of exercise of<br \/>\n\tdiscretion under Section 115 of the Indian Penal Code as under :-\n<\/p>\n<p>\t&#8220;It<br \/>\n\tis well-settled position in law that under Section 115 of the Code<br \/>\n\tof Civil Procedure the High Court cannot re-appreciate the evidence<br \/>\n\tand cannot set aside the concurrent findings of the Courts below by<br \/>\n\ttaking a different view of the evidence. The High Court is empowered<br \/>\n\tonly to interfere with the findings of fact if the findings are<br \/>\n\tperverse or there has been a non-appreciation or non-consideration<br \/>\n\tof the material evidence on record by the courts below. Simply<br \/>\n\tbecause another view of the evidence may be taken is no ground by<br \/>\n\tthe High Court to interfere in its revisional jurisdiction.&#8221;\n<\/p>\n<p>Therefore,<br \/>\n\tthe Court is not inclined to interfere with the concurrent findings<br \/>\n\tof fact in exercise of revisional jurisdiction. However, considering<br \/>\n\tthe observation and submissions, it would be in the fitness of<br \/>\n\tthings that while disposing of this Revision Application, some<br \/>\n\tdirections are required to be given to the respondent-tenant.\n<\/p>\n<p>The<br \/>\n\trespondent-tenant is hereby direct to file an undertaking before<br \/>\n\tthis Court in this Revision Application within a week stating that<br \/>\n\the will comply with all the requirements and shall pay regular rent<br \/>\n\tfrom 1999 onwards as required under the law. If the respondent fails<br \/>\n\tto comply with the undertaking, it will be open for the applicant to<br \/>\n\ttake appropriate steps.\n<\/p>\n<p>With<br \/>\n\tthese observations and directions, the present Civil Revision<br \/>\n\tApplication stands disposed of accordingly.
