No.12839 of 2011\n                                      GAUTAM KUMAR\n                                            Versus\n                                  THE STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>02.   25.04.2011            Heard learned counsel for the petitioner and<\/p>\n<p>                   the State.\n<\/p>\n<p>                            The      petitioner,     being     husband,     is<\/p>\n<p>                   apprehending his arrest in a case registered under<\/p>\n<p>                   section 498 (A), 323, 504, 34 of the Indian Penal<\/p>\n<p>                   Code.\n<\/p>\n<p>                            The marriage was performed in 2002 and<\/p>\n<p>                   from the wedlock there are three children. Petitioner<\/p>\n<p>                   is ready to keep the complainant as wife with full<\/p>\n<p>                   dignity and honour and the same gets reflected from<\/p>\n<p>                   the impugned order also. It is specifically denied<\/p>\n<p>                   that    the   petitioner    has   not   performed   second<\/p>\n<p>                   marriage, but the petitioner is apprehensive only<\/p>\n<p>                   with conduct of the complainant as she used to run<\/p>\n<p>                   away from the matrimonial house.\n<\/p>\n<p>                            Considering       the aforesaid   facts, let   the<\/p>\n<p>                   petitioner, above-named, be released on provisional<\/p>\n<p>                   anticipatory bail for six months in the event of arrest<\/p>\n<p>                   or surrender before the learned court below within a<\/p>\n<p>                   period of twelve weeks from today in connection<\/p>\n<p>                   with Complaint Case No. 564 of 2009 on furnishing<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>      bail bond of Rs. 10,000\/- (ten thousand) with two<\/p>\n<p>      sureties of the like amount each to the satisfaction<\/p>\n<p>      of the learned S.D.J.M., Patna City subject to the<\/p>\n<p>      conditions as laid down under section 438(2) of the<\/p>\n<p>      Code of Criminal Procedure.\n<\/p>\n<p>              Let the learned court below issue notice to<\/p>\n<p>      the complainant and on appearance the petitioner<\/p>\n<p>      will take the complainant to the matrimonial house<\/p>\n<p>      to keep her as wife with full dignity and honour.<\/p>\n<p>              The learned court below will be at liberty to<\/p>\n<p>      confirm the provisional anticipatory bail of the<\/p>\n<p>      petitioner if the matrimonial harmony is substantially<\/p>\n<p>      restored or the complainant deliberately refuses to<\/p>\n<p>      reside with the petitioner.\n<\/p>\n<\/p>\n<pre>SKM                        (Dinesh Kumar Singh, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Gautam Kumar vs The State Of Bihar on 25 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
