He also submitted<br \/>\n\tthat the main letters patent appeal be simultaneously heard on<br \/>\n\tmerits as he is ready for such purpose. Hence, in order to see that<br \/>\n\tthe merits of the matter may not be frustrated on account of delay,<br \/>\n\twe have also heard learned counsel for the applicant on merits of<br \/>\n\tthe letters patent appeal.\n<\/p>\n<p>If<br \/>\n\t the explanation given in the application for condonation of delay<br \/>\n\tis considered as it is, it is apparent that there is no sufficient<br \/>\n\texplanation for condonation of such a long delay of 1138 days, and<br \/>\n\thence, delay does not deserve to be condoned.\n<\/p>\n<p>Heard<br \/>\n\tlearned counsel appearing for the appellant on the merits of the<br \/>\n\tappeal. If the prayers made in the petition are considered as it is,<br \/>\n\tthey are on the premise that respondents have illegally appointed<br \/>\n\tcertain persons and the petitioner-present appellant, is seeking the<br \/>\n\tsame treatment. The another prayer in the petition is that the claim<br \/>\n\tof the petitioner is for having priority than the those persons who<br \/>\n\tare, as per the petitioner, illegally appointed by way of back-door<br \/>\n\tentry and; the third prayer is that the appointment of those persons<br \/>\n\tbe declared as illegal and in violation of Articles 14 and 16 of the<br \/>\n\tConstitution.\n<\/p>\n<p>The<br \/>\n\tlearned Single Judge has dismissed the petition on the ground that<br \/>\n\tthe persons, whose appointment is challenged, are not impleaded as<br \/>\n\tthe party, and therefore, the petition has been dismissed. As such,<br \/>\n\twhen the prayer is made for seeking a declaration that the<br \/>\n\tappointment made of certain persons be declared as illegal, those<br \/>\n\tpersons are necessary parties to the proceedings and without their<br \/>\n\tpresence, the relief cannot be considered. Hence, the discretion<br \/>\n\texercised by the learned Single Judge for dismissal of the petition,<br \/>\n\tsince the necessary parties to the proceedings were not joined,<br \/>\n\tcannot be said as erroneous.\n<\/p>\n<p>Apart<br \/>\n\tfrom the above, even if the reliefs prayed in the petition are<br \/>\n\tconsidered as it is, the petitioner is seeking equal treatment at<br \/>\n\tpar with those who are illegally appointed, as per the petitioners<br \/>\n\tthemselves. It is well settled position of law that Articles 14 and<br \/>\n\t16 cannot be invoked for putting the case at par with illegal<br \/>\n\taction.      If the appointment of those persons were illegal as per<br \/>\n\tthe petitioner, the petitioner would not be entitled to such relief.<br \/>\n\tFurther, the petitioner was working on purely temporary and<br \/>\n\tad-hoc basis and no right can be read with the petitioner for<br \/>\n\tpermanency benefits or regularization and or absorption, as sought<br \/>\n\tto be canvassed.\n<\/p>\n<p>In<br \/>\n\tview of the above, we find that there is no case on merits even in<br \/>\n\tthe letters patent appeal. Hence, no useful purpose would be served<br \/>\n\tin condoning the delay. Hence, the application for condonation of<br \/>\n\tdelay is rejected.
