Whether the judgment should be reported in the Digest?\n\nAjay Tewari, J.\n<\/pre>\n<p>                   This revision has been filed against an order rejecting an<\/p>\n<p>application for additional evidence.\n<\/p>\n<p>                   Learned counsel for the petitioner has argued that during<\/p>\n<p>the pendency of the civil suit for permanent injunction that he is a tenant on<\/p>\n<p>the property in dispute and that he should not be dispossessed except in due<\/p>\n<p>course of law, the respondents have been convicted of offences under<\/p>\n<p>sections 457\/411\/447\/427 IPC in relation to the same property.           He has<\/p>\n<p>argued that this evidence clearly reveals that the petitioner was in<\/p>\n<p>possession on the date the suit was filed.       The learned trial Court has<\/p>\n<p>rejected the application on well reasoned and cogent grounds holding that<\/p>\n<p>firstly, the conviction is subject to appeal and that secondly, the civil suit<br \/>\n<span class=\"hidden_text\"> Civil Revision No. 3456 of 2009                  -2-<\/span><\/p>\n<p>would necessarily have to be decided on the basis of evidence which would<\/p>\n<p>be led in the trial and thus would be much more relevant than this<\/p>\n<p>conviction order.\n<\/p>\n<p>            In my opinion there is no perversity or illegality in the<\/p>\n<p>impugned order.\n<\/p>\n<p>            Consequently this revision is dismissed.
