But the contention of the claimant is that they are not in<br \/>\n\ta position to comply with the condition since they are labourers and<br \/>\n\tthe can at the most file an undertaking for such purpose.\n<\/p>\n<p>It<br \/>\n\tappears to us that in a claim petition, normally, the direction to<br \/>\n\tfurnish solvent security and surety of the like amount would<br \/>\n\tpractically deprive the claimant to have the fruits of the<br \/>\n\tlitigation even if they have succeeded before the Tribunal.  But at<br \/>\n\tthe same time, the amount of withdrawal can be restricted in order<br \/>\n\tto see that if ultimately, the insurance company succeeds in the<br \/>\n\tappeal, effective orders can be passed in its favour for getting<br \/>\n\tback the amount.\n<\/p>\n<p>Hence,<br \/>\n\tit is observed and directed that in all the matters, 20% withdrawal<br \/>\n\tshall be permitted by the Tribunal from the amount deposited by the<br \/>\n\tinsurance company in the respective appeals, on filing an<br \/>\n\tundertaking by the concerned claimant that in the event they lose in<br \/>\n\tthe appeal, the amount shall be refunded by them, if it is so<br \/>\n\tdirected by this Court. The remaining amount of 80% amount shall be<br \/>\n\tinvested by the Tribunal initially for a period of 3 years and such<br \/>\n\tinvestment shall be renewed from time to time until final disposal<br \/>\n\tof the appeal.  The concerned claimant shall be entitled to the<br \/>\n\tperiodical interest from time to time.  Order dated 28.04.2010 in<br \/>\n\tCivil Application No.4382\/10 and allied matters shall stand modified<br \/>\n\tto the aforesaid extent.\n<\/p>\n<p>Applications<br \/>\n\tallowed to the aforesaid extent.
