{"id":223900,"date":"2009-08-18T00:00:00","date_gmt":"2009-08-17T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/gurdish-kaur-vs-state-of-punjab-on-18-august-2009"},"modified":"2016-07-10T05:03:53","modified_gmt":"2016-07-09T23:33:53","slug":"gurdish-kaur-vs-state-of-punjab-on-18-august-2009","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/gurdish-kaur-vs-state-of-punjab-on-18-august-2009","title":{"rendered":"Gurdish Kaur vs State Of Punjab on 18 August, 2009"},"content":{"rendered":"<div class=\"docsource_main\">Punjab-Haryana High Court<\/div>\n<div class=\"doc_title\">Gurdish Kaur vs State Of Punjab on 18 August, 2009<\/div>\n<pre>CRM-M19953 of 2009 (O&amp;M)                                1\n\nIn the High Court for the States of Punjab and Haryana at\nChandigarh.\n\n\n               Decided on Aug 18,2009.\n\n\n\nGurdish Kaur                            -- Petitioner\n\n\n                    vs.\n\n\nState of Punjab                         --Respondent.<\/pre>\n<p>CORAM:HON&#8217;BLE MR.JUSTICE RAKESH KUMAR JAIN<\/p>\n<p>Present:     Mr.Sarbjit Singh,Advocate, for the petitioner<\/p>\n<p>             Mr.Ranbir singh Rawat,A.A.G.Punjab, for the<br \/>\n             respondent\/State.\n<\/p>\n<p>\nRakesh Kumar Jain, J:\n<\/p>\n<\/p>\n<p>             The     petitioner   has    applied    for     anticipatory   bail<\/p>\n<p>apprehending      her arrest in   case registered vide FIR No.258 dated<\/p>\n<p>04.7.2009 under Sections 419,420,468,471,120-B IPC at Police Station,<\/p>\n<p>Civil Lines, Amritsar.\n<\/p>\n<p>             The aforesaid FIR has been registered on the complaint of<\/p>\n<p>Himanshu Thapliyal, Assistant Manager Operation Planet, Edu Pvt.<\/p>\n<p>Limited, 101, Greenwood Plaza, Greenwood City, Sector 45, Gurgaon.<\/p>\n<p>             In brief, the allegations are that         M\/S.Planet    Edu.Pvt.<\/p>\n<p>Limited is having its Corporate office at Sector 45,Gurgoan and has<\/p>\n<p>its branch   office at 41, Feroz Gandhi Market Ludhiana (Punjab) and is<\/p>\n<p>engaged in the business of conducting and facilitating International<br \/>\n<span class=\"hidden_text\"> CRM-M19953 of 2009 (O&amp;M)                          2<\/span><\/p>\n<p>English Language Test System (in short,&#8217;IELTS&#8217;) all over the country,<\/p>\n<p>through its office and test centres on behalf of IDP, IELTS, Australia. It<\/p>\n<p>is further alleged that on 4.7.2009, IELTS conducted a test at Hotel MK<\/p>\n<p>International, Ranjeet Avenue, Amritsar. At that time, persons namely<\/p>\n<p>Shikha Rai, Sidarth Sehgal, Surjit Singh, Shivani Sharma and Sorab<\/p>\n<p>Dinkar Verma came to the registration desk for admission for test and<\/p>\n<p>submitted their photographs and signed the terms and conditions of the<\/p>\n<p>IELTS Examination. They obtained admission tickets for taking the<\/p>\n<p>examination. The officers responsible for taking the examination became<\/p>\n<p>suspicious qua the genuineness of the passports shown to them. After<\/p>\n<p>scrutiny, it was found that the above said persons have tampered with the<\/p>\n<p>passports by putting their own photographs on them in order to take<\/p>\n<p>examination on behalf of some other persons by way of impersonation.<\/p>\n<p>Immediately, the aforesaid persons were apprehended. Their passports<\/p>\n<p>were taken into custody and they were handed over to the police. It was<\/p>\n<p>then found that the aforesaid persons were impersonating the candidates<\/p>\n<p>namely Ms. Gurdish Kaur Gill, Gurvinder           Singh, Ranjit Singh ,<\/p>\n<p>Rajwinder Kaur and Navdeep.\n<\/p>\n<p>            It is pertinent to mention here that before coming to this<\/p>\n<p>Court, the petitioner had applied for anticipatory bail before the learned<\/p>\n<p>Addl.Sessions Judge, Amritsar, which was dismissed on 14.7.2009 on<\/p>\n<p>the ground that the petitioners is the beneficiary in the entire game of<\/p>\n<p>cheating as test was being taken by those persons who are apprehended at<\/p>\n<p>the spot by tampering their passports which were naturally handed<\/p>\n<p>over to them by the petitioner.\n<\/p>\n<p>            Learned counsel for the petitioner has argued that in order<br \/>\n<span class=\"hidden_text\"> CRM-M19953 of 2009 (O&amp;M)                           3<\/span><\/p>\n<p>to take higher education abroad, there is a condition that at the time of<\/p>\n<p>grant of visa to aspirants who wanted to go to Australia, she should go<\/p>\n<p>through IELTS and obtain a particular standard\/ marks. It is further<\/p>\n<p>submitted that the company like the complainant have opened various<\/p>\n<p>centres through the country alluring innocent students assuring them that<\/p>\n<p>they shall get them visa by completing all the formalities including<\/p>\n<p>IELTS and shall send them to Australia.         It is further submitted that<\/p>\n<p>under this allurement, the agents in Amritsar have taken the amounts<\/p>\n<p>from Rs. 3,00,000\/- to Rs.5,00,000\/-      from individual student and<\/p>\n<p>collected their passports by obtaining signatures on various documents<\/p>\n<p>to complete formalities. It is submitted that the petitioner had paid Rs.<\/p>\n<p>2,00,000\/ to the complainant in this regard.      It is also submitted that<\/p>\n<p>neither the petitioner was aware of any test to be conducted by the<\/p>\n<p>complainant company nor she handed over the passports to a person<\/p>\n<p>who is alleged to have impersonated. Therefore, it is submitted that no<\/p>\n<p>offence has been committed by the petitioner.\n<\/p>\n<p>            I have heard learned counsel for the         parties and have<\/p>\n<p>perused the record.\n<\/p>\n<p>            It is more or less admitted by the petitioner that an amount<\/p>\n<p>of Rs.2,00,000\/- was paid by them in order to get all the formalities<\/p>\n<p>completed for the purpose of seeking admission in an educational<\/p>\n<p>institution in Australia. It is un-comprehensible that a person much-<\/p>\n<p>less a student who is desirous of getting admission in Australia is<\/p>\n<p>not aware of the procedure of passing the IELTS. Admittedly, the<\/p>\n<p>petitioner is beneficiary whose passport have been found in possession<\/p>\n<p>of the person who has been arrested in the course of his taking the<br \/>\n<span class=\"hidden_text\"> CRM-M19953 of 2009 (O&amp;M)                           4<\/span><\/p>\n<p>examination by impersonation.\n<\/p>\n<p>            Thus, keeping in view the seriousness of the offence and the<\/p>\n<p>fact that the investigation in the matter is required to unearth the big<\/p>\n<p>racket which is in operation, I do not find it to be a fit case for grant of<\/p>\n<p>anticipatory bail.
