DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/10\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tHeard<br \/>\nlearned advocate for the petitioner.\n<\/p>\n<p>\tLearned<br \/>\nadvocate submits that pursuant to the Godhra incident a communal riot<br \/>\nerupted where the petitioner received 15% burn injuries and was<br \/>\ntreated at Government hospital by the Medical Officer who had issued<br \/>\ncertificate accordingly.  As per the policy of the State of Gujarat<br \/>\nenumerated in Government Resolutions dated 4.3.2002 and 30.4.2002<br \/>\npersons including Government employees who received injuries during<br \/>\ncommunal riots were entitled to receive compensation and case of the<br \/>\npetitioner was recommended by the Mamlatdar to District Collector,<br \/>\nSurrendranagar, refused compensation to the petitioner on the ground<br \/>\nthat the application was preferred by the petitioner after a lapse of<br \/>\nsix years though no upper limit to receive the compensation is<br \/>\nprescribed in the Government Resolution.\n<\/p>\n<p>\tIn<br \/>\nview of the above, issue notice returnable on 18th<br \/>\nOctober, 2011 and if proper decision is not taken or the<br \/>\norder dated 9.1.2009 passed by the District Collector,<br \/>\nSurrendranagar, is not reviewed, since similarly situated employees<br \/>\nare considered for compensation in terms of the Government<br \/>\nResolution, appropriate order will be passed including directing the<br \/>\nCollector to remain personally present before this Court.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>[ANANT<br \/>\nS.
