\u00a0 of \u00a0 finally \u00a0 by \u00a0 the \u00a0 order \u00a0 dated \u00a0 6.5.2005. \u00a0 Aggrieved \u00a0 the\u00a0\nappellant,\u00a0who\u00a0was\u00a0Respondent\u00a0No.\u00a04\u00a0in\u00a0the\u00a0writ\u00a0petition,\u00a0has\u00a0filed\u00a0<\/pre>\n<p>the\u00a0present\u00a0appeal.\u00a0\n<\/p>\n<p>       In \u00a0 the \u00a0 appeal \u00a0 there \u00a0 is \u00a0 an \u00a0 application \u00a0 No.10487\/2008 \u00a0 for\u00a0<br \/>\ntaking\u00a0suitable\u00a0action\u00a0against\u00a0Respondent\u00a0No.\u00a02\u00a0under\u00a0Section\u00a0340\u00a0<br \/>\nof\u00a0the\u00a0Criminal\u00a0Procedure\u00a0Code.\u00a0It\u00a0has\u00a0been\u00a0mentioned\u00a0in\u00a0the\u00a0said\u00a0<br \/>\napplication \u00a0 that \u00a0 the \u00a0 said \u00a0 Respondent \u00a0 No. \u00a0 2 \u00a0 Mr. \u00a0 B. \u00a0 L. \u00a0 Patel \u00a0 is\u00a0<br \/>\nhabitual\u00a0in\u00a0making\u00a0false\u00a0complaints,\u00a0and\u00a0repeated\u00a0inquiries\u00a0have\u00a0<br \/>\nfound\u00a0that\u00a0the\u00a0complaints\u00a0made\u00a0by\u00a0Mr.\u00a0Patel\u00a0are\u00a0totally\u00a0false.\u00a0It\u00a0has\u00a0<br \/>\nalso\u00a0been\u00a0alleged\u00a0in\u00a0Paragraph\u00a0No.\u00a03\u00a0of\u00a0the\u00a0said\u00a0I.A.\u00a0that\u00a0Mr.\u00a0Patel\u00a0<br \/>\nhas\u00a0made\u00a0it\u00a0a\u00a0habit\u00a0to\u00a0misuse\u00a0the\u00a0process\u00a0of\u00a0Court\u00a0by\u00a0furnishing\u00a0<br \/>\nwrong\u00a0information,\u00a0misleading\u00a0the\u00a0Court,\u00a0forging\u00a0documents\u00a0and\u00a0<br \/>\nsuppressing\u00a0vital\u00a0facts.\u00a0\n<\/p>\n<p>       By\u00a0order\u00a0dated\u00a04.3.2009,\u00a0wherein\u00a0the\u00a0said\u00a0Respondent\u00a0No.\u00a02\u00a0<br \/>\nMr.\u00a0Patel\u00a0was\u00a0represented\u00a0by\u00a0Mr.\u00a0Manas\u00a0Verma\u00a0Advocate,\u00a0reply\u00a0to\u00a0<br \/>\nthe\u00a0said\u00a0I.\u00a0A.\u00a0No.10487\/2008\u00a0was\u00a0required\u00a0to\u00a0be\u00a0filed\u00a0by\u00a0Mr.\u00a0Patel\u00a0<br \/>\nwithin \u00a0 two \u00a0 weeks. \u00a0 No \u00a0 reply \u00a0 was \u00a0 filed \u00a0 and \u00a0 on \u00a0 29.11.2010 \u00a0 two\u00a0<br \/>\nweeks\u00a0further\u00a0time\u00a0was\u00a0granted\u00a0to\u00a0the\u00a0said\u00a0Respondent\u00a0No.\u00a02\u00a0to\u00a0file\u00a0<br \/>\nreply\u00a0to\u00a0the\u00a0said\u00a0application,\u00a0yet\u00a0no\u00a0reply\u00a0has\u00a0been\u00a0filed.\u00a0Today\u00a0the\u00a0<br \/>\nlearned\u00a0counsel\u00a0for\u00a0Respondent\u00a0No.\u00a02\u00a0has\u00a0prayed\u00a0for\u00a0two\u00a0weeks\u00a0<br \/>\nfurther\u00a0time\u00a0to\u00a0file\u00a0the\u00a0reply.\u00a0\n<\/p>\n<p>        Having\u00a0regard\u00a0to\u00a0what\u00a0has\u00a0been\u00a0said\u00a0aforesaid,\u00a0we\u00a0are\u00a0of\u00a0the\u00a0<br \/>\nopinion\u00a0that\u00a0Respondent\u00a0No.\u00a02\u00a0is\u00a0taking\u00a0this\u00a0Court\u00a0for\u00a0granted\u00a0and\u00a0<br \/>\ndeliberately \u00a0 avoiding\u00a0 filing\u00a0 of \u00a0 reply.\u00a0 The\u00a0 allegations \u00a0against \u00a0Sri\u00a0<br \/>\nPatel\u00a0are\u00a0serious.\u00a0He\u00a0has\u00a0not\u00a0rebutted\u00a0the\u00a0allegation\u00a0despite\u00a0being\u00a0<br \/>\ngranted \u00a0 time \u00a0 since \u00a0 4\u00ad3\u00ad2009. \u00a0 The \u00a0 allegations \u00a0 shake \u00a0 the \u00a0 very\u00a0<br \/>\nfoundations\u00a0of\u00a0administration\u00a0of\u00a0Justice.\u00a0\u00a0\u00a0\n<\/p>\n<p>       In\u00a0the\u00a0circumstances\u00a0it\u00a0is\u00a0directed\u00a0that\u00a0Respondent\u00a0No.\u00a02,\u00a0<br \/>\nwho \u00a0 is \u00a0 a \u00a0 Assistant \u00a0 Teacher, \u00a0 shall \u00a0 be \u00a0 suspended \u00a0 from \u00a0 service\u00a0<br \/>\nforthwith\u00a0by\u00a0the\u00a0competent\u00a0officer\u00a0of\u00a0the\u00a0State\u00a0Government\u00a0who\u00a0is\u00a0<br \/>\nempowered\u00a0to\u00a0suspend\u00a0Sri\u00a0Patel.\u00a0He\u00a0will\u00a0be\u00a0kept\u00a0under\u00a0suspension\u00a0<br \/>\nduring \u00a0 the \u00a0 pendency \u00a0 of \u00a0 the \u00a0 application \u00a0 No.10487\/2008 \u00a0 and \u00a0 the\u00a0<br \/>\ncriminal \u00a0 proceedings, \u00a0 if \u00a0 any, \u00a0 launched \u00a0 pursuant \u00a0 to \u00a0 the \u00a0 said\u00a0<br \/>\napplication.\u00a0Whether\u00a0such\u00a0proceedings\u00a0should\u00a0be\u00a0launched\u00a0will\u00a0be\u00a0<br \/>\nconsidered\u00a0on\u00a0the\u00a0next\u00a0date.\u00a0\n<\/p>\n<p>       List\u00a0on\u00a029.9.2011.\u00a0State\u00a0Govt.\u00a0will\u00a0ensure\u00a0compliance\u00a0with\u00a0<br \/>\nthis\u00a0order,\u00a0and\u00a0file\u00a0a\u00a0compliance\u00a0report\u00a0by\u00a0the\u00a0next\u00a0date.\u00a0\n<\/p>\n<p>       Mr.\u00a0Patel\u00a0may\u00a0file\u00a0his\u00a0reply\u00a0by\u00a0that\u00a0date.\n<\/p>\n<p>       Certified\u00a0copy\u00a0as\u00a0per\u00a0rules.\n<\/p>\n<pre>
