Justice ANTONY DOMINIC\n\n Dated :08\/12\/2009\n\n O R D E R\n                     ANTONY DOMINIC, J.\n         W.P.(C.)-------------------------of 2009\n                  Nos.28117, 30610 &amp; 31657\n           ---------------------------------\n          Dated, this the 8th day of December, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>     The petitioners are candidates having valid registration in the<\/p>\n<p>Employment Exchanges in the State. Their grievance is that the 7th<\/p>\n<p>respondent is making appointments to the post of Junior Health<\/p>\n<p>Inspector Grade II for specified duration not from candidates<\/p>\n<p>sponsored by the Employment Exchanges. It is stated that earlier<\/p>\n<p>such appointments were being made from among candidates<\/p>\n<p>sponsored by the Employment Exchanges.          However, recently,<\/p>\n<p>dispensing with the said system of making appointments from<\/p>\n<p>among the Employment Exchange candidates, the 7th respondent is<\/p>\n<p>making appointments from the list maintained by the Public Service<\/p>\n<p>Commission.\n<\/p>\n<p>     2.   According to the petitioners, those included in the list<\/p>\n<p>published by the PSC do not possess the qualification prescribed for<\/p>\n<p>the post of Junior Health Inspector Grade II as per Ext.P1<\/p>\n<p>Government Order.     It is complaining of the appointments of<\/p>\n<p>WP(C) Nos.28117, 30610 &amp; 31657\/2009<br \/>\n<span class=\"hidden_text\">                                   -2-<\/span><\/p>\n<p>persons, who are alleged as unqualified, made from the PSC list,<\/p>\n<p>that these writ petitions are filed.\n<\/p>\n<p>      3.   The learned standing counsel appearing for the 7th<\/p>\n<p>respondent has obtained instructions and submits that the<\/p>\n<p>appointments are made at district level by a Society, of which the<\/p>\n<p>DMO is the Chief Executive Officer. It is stated that earlier, the<\/p>\n<p>Society was making appointments from among candidates<\/p>\n<p>sponsored by the Employment Exchanges. But, however, having<\/p>\n<p>regard to the complaints they have been received against such<\/p>\n<p>appointments, the said system was given a go-bye. It is stated that<\/p>\n<p>since then, it has been decided that in future, appointments will be<\/p>\n<p>made from the list published by the PSC. It is also pointed out that<\/p>\n<p>the 7th respondent is not bound by the qualifications prescribed in<\/p>\n<p>Ext.P1, which are applicable to the Junior Health Inspector Gr.II in<\/p>\n<p>the Health Services Department.\n<\/p>\n<p>      4.   Ext.P1 prescribes the qualification for the post of Junior<\/p>\n<p>Health Inspector Gr.II in the Health Services Department. There is<\/p>\n<p>nothing to indicate that the appointments at District Level made by<\/p>\n<p>the Society mentioned above under the control of the 7th respondent<\/p>\n<p>WP(C) Nos.28117, 30610 &amp; 31657\/2009<br \/>\n<span class=\"hidden_text\">                                   -3-<\/span><\/p>\n<p>are a part of the Health Services Department. If so, this Court will<\/p>\n<p>not be justified in insisting that the 7th respondent or the Society<\/p>\n<p>should follow the qualifications applicable to the Junior Health<\/p>\n<p>Inspector Gr.II in the Health Services Department.<\/p>\n<p>      5.   Be that as it may, it is now pointed out by the learned<\/p>\n<p>standing counsel appearing for the 7th respondent that the absence<\/p>\n<p>of qualification prescribed in Ext.P1, in respect of those who are<\/p>\n<p>sponsored by the PSC, was not notified by anybody to them, and<\/p>\n<p>that in future, if and when any engagement is made, the 7th<\/p>\n<p>respondent and the District Level Society will consider this matter.<\/p>\n<p>      Therefore, recording the above submission, these writ<\/p>\n<p>petitions are closed.\n<\/p>\n<\/p>\n<p>                                   (ANTONY DOMINIC, JUDGE)<br \/>\njg<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sanjeev P. vs The State Of Kerala on 8 December, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 28117 of 2009(H) 1.
