The petitioner<\/p>\n<p>is engaged in the business of sale of bottled drinking water.<\/p>\n<p>According to the petitioner, he was engaging his own<\/p>\n<p>permanent workers for all the works connected with the<\/p>\n<p>factory, including loading and unloading. Loading and<\/p>\n<p>unloading are incidental to the main work.<\/p>\n<p>      2. Respondents 5 and 6 and their members, however,<\/p>\n<p>asserted that they were denied loading and unloading in the<\/p>\n<p>establishment of the petitioner. Being a disputed the<\/p>\n<p>question of fact, this Court by an elaborate interim order<\/p>\n<p>passed on 23-12-2009 directed the Asst. Labour Officer to<\/p>\n<p>verify the registers maintained by the petitioner and if it is<\/p>\n<p>found that the petitioner is engaging his own permanent<\/p>\n<p>workers for loading and unloading, the petitioner is entitled<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 34494\/09          2<\/span><\/p>\n<p>to get police protection. The Asst. Labour Officer, after due<\/p>\n<p>enquiry, filed a report, as per which, it is stated that the<\/p>\n<p>Headload Workers (Regulation of Employment and Welfare)<\/p>\n<p>Scheme has been brought into force in the area where the<\/p>\n<p>petitioner&#8217;s establishment is situated. The petitioner by<\/p>\n<p>Ext.P1 has applied for registration of his permanent workers.<\/p>\n<p>Those permanent workers, according to him, were engaged<\/p>\n<p>for loading and unloading work. Since the scheme is<\/p>\n<p>implemented only very recently and since the application for<\/p>\n<p>registration      is pending consideration   before  the   3rd<\/p>\n<p>respondent, it is assured by respondents 5 and 6 that they<\/p>\n<p>will not cause any physical obstruction to the works of the<\/p>\n<p>petitioner&#8217;s establishment. However, they plead that they<\/p>\n<p>may also be heard by the Asst. Labour Officer before final<\/p>\n<p>decision is taken on Ext.P1.\n<\/p>\n<p>        3. Having heard both sides, and having consideration<\/p>\n<p>of the submissions made, there will be a direction that so<\/p>\n<p>long as the petitioner engaged his own permanent workers<\/p>\n<p>for loading and unloading operations, there will not be any<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 34494\/09              3<\/span><\/p>\n<p>objection caused by respondents 5 and 6. The Asst. Labour<\/p>\n<p>Officer shall take and pass orders on Ext.P1 as expeditiously<\/p>\n<p>as possible, at any rate within six weeks from the date of<\/p>\n<p>receipt of copy of this judgment and after hearing the<\/p>\n<p>petitioner and respondents 5 and 6. In case no registration is<\/p>\n<p>granted, then the petitioner will not be entitled to protection<\/p>\n<p>by virtue of this judgment.
