RESHMI KUMARI, WIFE OF TAPAS KUMAR ROY\n                                          ...OPPOSITE PARTIES\n                      For the petitioner :Mr.Randhir Kumar no.1\n                      For the State      :Mr. Permeshwar Mehta,APP\n\n                                          -----------\n<\/pre>\n<p>04.   30.09.2010                 Heard both sides.\n<\/p>\n<p>                                 Petitioner is an accused facing prosecution under<\/p>\n<p>                   sections 307 and 498A IPC including section \u00be of the Dowry<\/p>\n<p>                   Prohibition Act. He is aggrieved by order dated 02.02.2008,<\/p>\n<p>                   passed by learned trial Judge in S.T.No.527\/2007, whereby his<\/p>\n<p>                   application filed under sections 227 and 228 Cr.P.C. has been<\/p>\n<p>                   considered and rejected.\n<\/p>\n<p>                                 The impugned order was passed on 02.02.2008.<\/p>\n<p>                   Present application was lodged in this Court on 16.04.2008. No<\/p>\n<p>                   interim protection was granted to the petitioner. By order dated<\/p>\n<p>                   08.09.2010, this court directed the petitioner to file a<\/p>\n<p>                   supplementary affidavit disclosing the status\/result of the<\/p>\n<p>                   proceeding.\n<\/p>\n<p>                                 Counsel for the petitioner fairly states that during the<\/p>\n<p>                   pendency of this application charges have been framed and trial<\/p>\n<p>                   has commenced in which one witness has been examined. The<\/p>\n<p>                   grievance of the petitioner in the present application is that based<\/p>\n<p>                   on materials available on record no case under section 307 IPC<\/p>\n<p>                   is made out. It is submitted that after the alleged attempt to<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>     commit the offence in a motel the complainant\/informant as well<\/p>\n<p>     as the present petitioner travelled together. Subsequent thereto,<\/p>\n<p>     as per the allegation, she was again subjected to torture and<\/p>\n<p>     ousted from matrimonial home. It is contended that there is no<\/p>\n<p>     injury report also.\n<\/p>\n<p>                 Be that as it may, since the trial has already<\/p>\n<p>     commenced this court declines to interfere with the order.<\/p>\n<p>                 Petitioner shall have liberty to raise\/agitate all these<\/p>\n<p>     facts\/grievances before learned trial Judge which shall be<\/p>\n<p>     considered at the time of final disposal of the matter.<\/p>\n<p>                 The application is accordingly disposed of.<\/p>\n<p>                               ( Kishore K.
