M. SAHAI)<\/a><\/p>\n<p>1.\tWe have<br \/>\nheard learned counsel Mr. Ashish H. Shah for the petitioner and<br \/>\nlearned Assistant Government Pleader Mr. N.J. Shah appearing for<br \/>\nrespondent Nos.1 and 2.\n<\/p>\n<p>2.\tThe<br \/>\nlearned counsel for the petitioner has placed reliance on para 29 of<br \/>\nthe judgment rendered in the case of Shrutbandhu H. Popat Vs.<br \/>\nState of Gujarat and others, 2008(1) GLH 575 and has urged<br \/>\nthat the name of the petitioner has wrongly not been included in the<br \/>\nvoter list, though the petitioner holds licence for carrying on<br \/>\nbusiness in the Himmatnagar Agriculture Produce Market.\n<\/p>\n<p>3.\tThe Full<br \/>\nBench of this Court in Daheda Group Seva Sahakari Mandli<br \/>\nLimited v.R.D.Rohit, Authorised Officer and Co Operative Officer<br \/>\n(Marketing) 2006-GCD-211 has observed as under:\n<\/p>\n<p>&#8220;i.\n<\/p>\n<p>\tA person whose name is not included in the voters&#8217; list can avail<br \/>\nbenefit of provisions of Rule 28 of the Rules by filing Election<br \/>\nPetition.\n<\/p>\n<p>ii.\n<\/p>\n<p>\tAs the authority under Rule 28 has wide power to cancel confirm and<br \/>\namend the election and to direct to hold fresh election in case the<br \/>\nelection is set aside, remedy under Rule 28is an efficacious remedy.\n<\/p>\n<p>iii.\n<\/p>\n<p>\tEven though a petition under Article 226 of the Constitution of<br \/>\nIndia is maintainable though alternative remedy is available, the<br \/>\npowers are to be exercised in case of extraordinary or special<br \/>\ncircumstances such as where the order is ultra vires or nullity<br \/>\nand\/or ex facie without jurisdiction. The exclusion or inclusion of<br \/>\nnames in the voters&#8217; list cannot be termed as extraordinary<br \/>\ncircumstances warranting interference by this Court under Article 226<br \/>\nof the Constitution of India and such questions are to be decided in<br \/>\nan Election Petition under Rule 28 of the Rules.&#8221;\n<\/p>\n<p>4.\t\tIn<br \/>\nview of the aforesaid decision of the Full Bench of this Court, since<br \/>\nthe petitioner has got an alternative remedy of filing an Election<br \/>\nPetition, we are not inclined to interfere in the matter.
