The accused after writing the paper did not handover<br \/>\nthe answer book to the Invigilator\/ Supervisor and left the seat with<br \/>\nthe answer paper. At the end of the session, supervisor concerned<br \/>\nfound that answer book of the student of seat no.50725 had not been<br \/>\nreceived, he informed the Director of examination of Gondal and the<br \/>\nDirector of examination filed the complaint.  On investigation, the<br \/>\nanswer paper was recovered as per the say of the prosecution from the<br \/>\nrespondent-accused by Investigating Officer.  As the accused has<br \/>\ncommitted criminal breach of trust, the charge<br \/>\nsheet came to be filed.  In the trial the accused pleaded not guilty<br \/>\nand trial began.  The Court ultimately after appreciating the<br \/>\nevidence on record, came to the conclusion that the prosecution<br \/>\nfailed in establishing its case against the accused so as to bring<br \/>\nabout  conviction.  Hence acquitted the accused of the charge of<br \/>\ncommitting offense punishable under Section 406 of Indian Penal Code<br \/>\nvide its order dated 11.2.2004, which is impugned in this Acquittal<br \/>\nAppeal under Section 378 (1) (3) of the Code of Criminal<br \/>\nProcedure,1973.\n<\/p>\n<p>(4).\tThis<br \/>\nCourt (Coram: Hon&#8217;ble Justice H.P. Antani, J.) by an order dated<br \/>\n7.3.2006 granted leave and admitted appeal and bailable warrant in<br \/>\nsum of Rs.5,000\/- was ordered to be issued to the respondent.  The<br \/>\nrecord and the remarks on the board indicates that the respondent is<br \/>\nduly served as could be seen from the report of the Principal Senior<br \/>\nCivil Judge &amp; Addl. Chief Judicial Magistrate, Gondal on<br \/>\n10.9.2006.  Though served, none appears for the respondent.\n<\/p>\n<p>(5).\n<\/p>\n<p>Learned A.P.P. , Shri Maulik Nanavaty contended that the reasoning<br \/>\nadopted by the Trial Court for recording acquittal being contrary to<br \/>\nlaw, the order  suffers from vulnerability and the same is required<br \/>\nto be quashed and set aside.\n<\/p>\n<p>(6).\tHowever,<br \/>\nShri Nanavaty could not controvert and make any other submissions in<br \/>\nrespect of the recording of the finding by the Court in respect of<br \/>\nthe lacuna in case of the prosecution so far as the recovery of the<br \/>\ndocuments in questions as well as the missing of link in the<br \/>\ntestimony of the invigilator \/ supervisor  who has also not clearly<br \/>\ndeposed with regard to the action of the examinee taking away answer<br \/>\nsheet from the examination hall.\n<\/p>\n<p>(7).\n<\/p>\n<p>One more aspect which needs to be considered is that though the<br \/>\nprosecution has attributed the handing over of the answer sheet to<br \/>\nthe examinee i.e. accused having seat no.50725, but the record<br \/>\nindicates that no evidence of handing over this answer sheet to the<br \/>\naccused has come on record except that the answer sheet bears the<br \/>\nseat number of the accused.\n<\/p>\n<p>(8)\tThere<br \/>\nis a presumption available in respect of accused being in the<br \/>\nexamination hall, but merely presumption cannot take the place of<br \/>\nproof especially when serious offence punishable under Section 406 is<br \/>\nsought to be proved.  The same being a material aspect, ought to have<br \/>\nbeen proved beyond doubt for bringing home guilt on the part of the<br \/>\naccused.\n<\/p>\n<p>(9).\tThis<br \/>\nCourt is of the view that as this being a glaring lacuna in case of<br \/>\nthe prosecution especially when the Panchnama of recovering those<br \/>\nexamination admission card as well as answer sheet have remained to<br \/>\nbe proved in view of the fact that the Panchas have not supported<br \/>\nPanchnama except qua the signature  and the Investigating Officer&#8217;s<br \/>\ntestimony not unequivocally indicating drawing of Panchnama or the<br \/>\ncontents thereof, which remained to be proved would go to show that<br \/>\nthe order impugned cannot be said to be so perverse, as to call for<br \/>\nany interference.  The Court hasten here to add that the recording of<br \/>\nacquittal on those grounds have to be appreciated.  While<br \/>\nappreciating this, the Court would not countenance the observation of<br \/>\nthe Trial Court with regard to penalty aspect by the board so as to<br \/>\nattract the provisions of Section 405 are not approved.  The Court<br \/>\ntherefore of the view that the appeal does not deserve acceptance,<br \/>\nthe same is hereby rejected.
