     The petitioner retired from service as Headmistress of<\/p>\n
Edamuttom      U.P.School,    Valappad     with  effect    from<\/p>\n
30\/06\/2005.     The petitioner was the senior most Primary<\/p>\n
School Assistant. On 01\/04\/2005, a vacancy of Headmaster<\/p>\n
arose in the school and the petitioner was promoted as<\/p>\n
Headmistress as per Ext.P1 order. Approval was sought and<\/p>\n
that was rejected by the 3rd respondent as per Ext.P2 order<\/p>\n
on the ground that the petitioner had permanently<\/p>\n
relinquished the post of Headmistress with effect from<\/p>\n
31\/03\/1986. Appeals filed against the said order were also<\/p>\n
rejected by Ext.P4 order of the 2nd respondent, and Ext.P9<\/p>\n
order passed by the Government.\n<\/p>\n
     2.    In the aforesaid circumstances, this writ petition is<\/p>\n
filed challenging Exts.P2, P4 & P9 orders and a direction is<\/p>\n
sought to the respondents to approve the appointment of the<\/p>\n

petitioner as Headmistress with all consequential benefits<\/p>\n
including arrears of pay, pensionary benefits etc.<\/p>\n
     3.    The learned Government Pleader refers to Ext.P10<\/p>\n
relinquishment given by the petitioner on 31\/03\/1986.<\/p>\n
According       to   the   learned    Government    Pleader,<\/p>\n
relinquishment made by the petitioner is permanent and<\/p>\n
she also makes particular reference to the last sentence of<\/p>\n
Ext.P10, which reads as under:-\n<\/p>\n
     “I   also   will not put-forth any future claim for<\/p>\n
     Headmastership.”\n<\/p>\n
Based on this, it is stated that the petitioner, having<\/p>\n
permanently relinquished the post of Headmistress, could<\/p>\n
not have been appointed to that post with effect from<\/p>\n
01\/04\/2005. On this basis, the learned Government Pleader<\/p>\n
seeks to sustain the impugned orders.\n<\/p>\n
     4.    I have considered the submissions made.      It is<\/p>\n
true that on 31\/03\/1986, the petitioner had relinquished the<\/p>\n
post of Headmistress and stated that she had no objection<\/p>\n
to the appointment of Shri.M.Ravindran as Headmaster in<\/p>\n

the vacancy which arose on 31\/03\/1986. It is also stated in<\/p>\n
Ext.P10 that she will not put-forth any future claim for the<\/p>\n
post of Headmistress.\n<\/p>\n
     5.    The effect of Ext.P10 is what is required to be<\/p>\n
considered in this writ petition. Appointment to the post of<\/p>\n
Headmaster in an aided school is as per Rule 44, Chapter<\/p>\n
49, of the K.E.R. The Note attached to the said Rule, which<\/p>\n
provides for relinquishment in the nature of Ext.P10, is<\/p>\n
extracted below for reference :-\n<\/p>\n
     “Note :- Whenever the Manager intends to appoint a<\/p>\n
     person as Headmaster other than the senior claimant, the<\/p>\n
     Manager shall obtain a written consent from such senior<\/p>\n
     claimant renouncing his claim permanently. Such consent<\/p>\n
     shall have the approval of the Educational Officer<\/p>\n
     concerned.”\n<\/p><\/blockquote>\n
This Note provides that “whenever the Manager intends to<\/p>\n
appoint” a person as Headmaster, who is not the senior<\/p>\n
teacher, the manager shall obtain a written consent from<\/p>\n
the senior teacher renouncing his\/her claim permanently. It<\/p>\n
is in pursuance to the note referred to above, that Ext.P10<\/p>\n

relinquishment has been given by the petitioner. The effect<\/p>\n
of Ext.P10 has been considered by this Court in various<\/p>\n
judgments. In George Vs. State of Kerala (1998(2) KLT<\/p>\n
637, this Court has held as follows :-\n<\/p>\n
     “Secondly, going by the Note itself, the said relinquishment<\/p>\n
     itself cannot be used on each and every occasion. The<\/p>\n
     expression “Whenever the Manager intends to appoint”<\/p>\n
     would show that whenever manager overlooks the claim of<\/p>\n
     a senior teacher to be appointed as Headmaster, manager<\/p>\n
     has to get a written consent from such senior claimant<\/p>\n
     renouncing his claim permanently. In other words, there<\/p>\n
     cannot be any permanent relinquishment to the post of<\/p>\n
     Headmaster. Apart from that, Ext.R3(a) cannot have any<\/p>\n
     legal validity, since no approval was obtained from the<\/p>\n
     educational officer concerned. Therefore, the same cannot<\/p>\n
     be given effect to for all years to come”.<\/p>\n<\/blockquote>\n
This judgment has been quoted with approval by a Division<\/p>\n
Bench judgment of this Court in Rajasree Vs. Secretary to<\/p>\n
Government (2000(2) KLT 248), wherein it has held that :<\/p>\n
     “Scope of R.44(I) was considered by this Court in George<\/p>\n
     Vs. State of Kerala (1998(2) KLT 637) and this court held<\/p>\n
     that there cannot be any permanent relinquishment to the<\/p>\n
     post of Headmaster. That apart, we are of opinion that<\/p>\n
     relinquishment can only be of an existing right.        Mere<\/p>\n
     chance of promotion is not a right and if it is not a<\/p>\n

     crystallized  right, there is no  question of any<\/p>\n
     relinquishment.”\n<\/p><\/blockquote>\n
Following these two judgments, a Division Bench of this<\/p>\n
Court, in Mariam Koshy Vs.        Jolly Varghese, (2007(4)<\/p>\n
KLT 803) held that whenever the Manager intends to<\/p>\n
appoint a person as Headmaster other than a senior<\/p>\n
claimant, the Manager shall obtain a written consent from<\/p>\n
such senior claimant renouncing his claim permanently.<\/p>\n
Therefore, the law laid down by the aforesaid three<\/p>\n
judgments is to the effect that there is no permanent<\/p>\n
relinquishment of the post of Headmaster, but whenever the<\/p>\n
manager intends to make appointment to the post of<\/p>\n
Headmaster by a person other than the senior claimant, the<\/p>\n
manager has to obtain a written consent from the senior<\/p>\n
claimant. Similar is the view taken by another bench of this<\/p>\n
Court in Muhammed Ashraf Vs. State of Kerala ( 2007(3)<\/p>\n
KLT 667).\n<\/p>\n
     6.    The learned Government Pleader relied on a<\/p>\n
Division Bench judgment of this Court in Joseph Vs. State<\/p>\n
WP(C) No.16966\/2008
\n                              -6-<\/span><\/p>\n
of Kerala (1987(2) KLT 579).       According to the learned<\/p>\n
Government Pleader, going by the law laid down in this<\/p>\n
judgment, once a permanent relinquishment is made, the<\/p>\n
teacher is not entitled to claim promotion to the post of<\/p>\n
Headmaster.\n<\/p>\n
     7.    However, I am not persuaded to accept the<\/p>\n
contention raised by the learned Government Pleader. That<\/p>\n
was a case where, though the teacher had relinquished his<\/p>\n
claim for promotion, subsequently he was promoted to the<\/p>\n
post of Headmaster and thereafter he claimed seniority over<\/p>\n
the person, who was promoted as Headmasters during the<\/p>\n
time when his relinquishment was in operation.        In such<\/p>\n
circumstances,      the Division   Bench   held    that once<\/p>\n
appointment       to the  post   of Headmaster     has been<\/p>\n
relinquished, it is not open to the teacher to claim seniority<\/p>\n
over the persons, who were promoted as Headmaster. In<\/p>\n
my view, the principle laid down by this Court in the<\/p>\n
judgment relied on by the learned Government Pleader<\/p>\n
cannot be imported to the facts of this case, where the<\/p>\n

petitioner is claiming promotion to the post of Headmaster<\/p>\n
and is not claiming seniority over the persons, who were<\/p>\n
promoted to the vacancies that arose prior to 01\/04\/2005.<\/p>\n
     8.    For all these reasons, I hold that Exts.P2, P4 & P9<\/p>\n
are illegal and the petitioner is entitled to approval as<\/p>\n
Headmistress with effect from 01\/04\/2005. Therefore, the<\/p>\n
writ petition is allowed, and the respondents are directed to<\/p>\n
approve the appointment of the petitioner as Headmistress<\/p>\n
with effect from 01\/04\/2005 with all consequential benefits<\/p>\n
including arrears of pay and pensionary benefits and all such<\/p>\n
other benefits.\n<\/p>\n
     The writ petition is allowed as above.\n<\/p>\n<\/p>\n
