Justice M.SASIDHARAN NAMBIAR\n\n Dated :20\/12\/2010\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.4333 of 2010\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioners 1 to 3 are the defacto complainants<\/p>\n<p>and the injured in C.C.No.726\/2010 and L.P.No.<\/p>\n<p>93\/2008  on  the  file  of   Judicial  First  Class<\/p>\n<p>Magistrate&#8217;s Court, Payyannur, taken cognizance for<\/p>\n<p>the offences under Sections 323, 324 and 326 read<\/p>\n<p>with Section 34 of Indian Penal Code. This petition<\/p>\n<p>is jointly filed by the defacto complainants and<\/p>\n<p>the accused to quash the proceedings contending<\/p>\n<p>that entire disputes were settled amicably.<\/p>\n<p>    2. Learned Public Prosecutor on instructions<\/p>\n<p>submitted that a counter case in Crime No.179\/2006<\/p>\n<p>as L.P.No.90\/2009 is pending against the third<\/p>\n<p>petitioner  before the learned Magistrate.<\/p>\n<p>    3.   Learned   counsel   appearing    for   the<\/p>\n<p>petitioners made available the affidavit signed by<\/p>\n<p>the  fourth   petitioner,   the   injured   defacto<\/p>\n<p>complainant  in   that   crime,   wherein,   fourth<\/p>\n<p><span class=\"hidden_text\">CRMC 4333\/10             2<\/span><\/p>\n<p>petitioner has declared that he has settled the<\/p>\n<p>disputes and is prepared to compound the offences<\/p>\n<p>before    the learned Magistrate.  Learned  counsel<\/p>\n<p>appearing for the petitioners also asserted that as<\/p>\n<p>all the disputes in the counter case have also been<\/p>\n<p>settled, it is not in the interest of justice to<\/p>\n<p>continue the prosecution.\n<\/p>\n<p>     Petition is allowed.
