SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 07\/05\/2007 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tConsidering<br \/>\nthe fact that the entire awarded amount has not been deposited by the<br \/>\nappellant before preferring the present first appeal and considering<br \/>\nthe proviso of section 30 of the Workmen&#8217;s Compensation Act, present<br \/>\nappeal is not required to be entertained. Hence, present appeal is<br \/>\ndismissed for want of deposit of entire awarded amount and production<br \/>\nof the certificate of the learned Commissioner for Workmen&#8217;s<br \/>\nCompensation to that effect.\n<\/p>\n<p>\tShri<br \/>\nParikh, learned advocate appearing on behalf of the appellant,-<br \/>\ninsurance company has submitted that the entire awarded amount shall<br \/>\nbe deposited within a period of three days from today and thereafter,<br \/>\nappeal will be filed. As and when the appeal is preferred along with<br \/>\nthe certificate of the learned Commissioner for Workmen&#8217;s<br \/>\nCompensation that entire awarded amount is deposited, the same shall<br \/>\nbe decided in accordance with law and on merits without raising any<br \/>\nobjection that the present appeal is dismissed. In the meantime and<br \/>\nso as to see that the amount awarded to the applicant is not<br \/>\nflittered away and not misused and misapplied, the learned<br \/>\nCommissioner for Workmen&#8217;s Compensation, Kutchh-Bhuj is directed not<br \/>\nto disburse the amount in favour of the applicant for a period of one<br \/>\nmonth, so as to enable the appellant to obtain appropriate order in<br \/>\nthe appeal and the civil application therein.\n<\/p>\n<p>\tWith<br \/>\nthis, the present appeal is dismissed with above liberty.\n<\/p>\n<p>\tIn<br \/>\nview of dismissal of present first appeal, no order in civil<br \/>\napplication.\n<\/p>\n<p>(M.R.\n<\/p>\n<p>Shah, J.)<\/p>\n<p>shekhar\/-\n<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<blockquote><p>\t\t   Top<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court National vs Tejmalsing on 12 October, 2010 Author: M.R.
