BASANT, J.\n                  - - - - - - - - - - - - - - - - - - - - - -\n                    Crl.M.C.No. 65 of 2009\n                  - - - - - - - - - - - - - - - - - - - - - -\n             Dated this the 13th day of January, 2009\n\n                               O R D E R\n<\/pre>\n<p>      The petitioners face indictment in a prosecution                  for<\/p>\n<p>offences punishable under Sections 498A and 313 I.P.C.<\/p>\n<p>Altogether there were five accused persons.                  Cognizance has<\/p>\n<p>been taken on the basis of the final report submitted by the police<\/p>\n<p>after due investigation.       Three of the five co-accused have<\/p>\n<p>already been tried, found not guilty and acquitted.                 As the<\/p>\n<p>petitioners were not available, the case against them was split up<\/p>\n<p>and refiled.\n<\/p>\n<p>      2. At this juncture, the petitioners and the second<\/p>\n<p>respondent have come before this Court to apprise this court of<\/p>\n<p>the fact that the parties have already settled all their outstanding<\/p>\n<p>disputes and the second respondent has compounded the offences<\/p>\n<p>allegedly committed by the petitioners. Annex.B is the judgment<\/p>\n<p>of acquittal in favour of the co-accused. That judgment also<\/p>\n<p>reveals that there has been a settlement\/composition.<\/p>\n<p>Crl.M.C.No. 65 of 2009<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>      3.    The second respondent has entered appearance through<\/p>\n<p>counsel and has filed an affidavit duly attested by the counsel to<\/p>\n<p>confirm that the parties have settled their disputes and the offences<\/p>\n<p>allegedly committed by the petitioners have been compounded by the<\/p>\n<p>second respondent.\n<\/p>\n<p>      4. Learned counsel for the petitioners and the second respondent<\/p>\n<p>pray, the learned Prosecutor does not oppose the said prayer and I am<\/p>\n<p>satisfied that the extra ordinary inherent jurisdiction as enabled by the<\/p>\n<p>dictum in    B.S. Joshi v. State of Haryana (AIR 2003 SC 1386)<\/p>\n<p>can safely be invoked to bring to premature termination the<\/p>\n<p>unnecessary     and   irrelevant  prosecution   surviving    against  the<\/p>\n<p>petitioners.\n<\/p>\n<p>      4. In the result:\n<\/p>\n<p>      a) This Crl.M.C. is hence allowed.\n<\/p>\n<p>      b) C.P. No. 111 of 2006, pending before the Judicial First<\/p>\n<p>Class Magistrate, Chavakkad against the        petitioners, in which the<\/p>\n<p>second respondent is the defacto complainant, is hereby quashed.<\/p>\n<p>Crl.M.C.No. 65 of 2009<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>      c) Needless to say, proceedings under Section 446 Cr.P.C., if<\/p>\n<p>any, pending against the petitioners and the sureties shall be disposed<\/p>\n<p>of in accordance with law.\n<\/p>\n<\/p>\n<p>                                            (R.
