her husband–Sri.T,N.Srinivasan;,<\/p>\n

\n4,’~_ On i3;07.2003 at about 5.50 p.m., when<\/p>\n
tenSri,T1\ufb01.\u00a7\ufb01iniyasanmeas walking on the footwpath side<\/p>\n
defsg ftixioad near Ishwara Bar and Restaurant, the<\/p>\n
V’=\u00bb ems egg bearing reg. No.KA-01-?-2414 came in a rash<\/p>\n
i*\u00ab and negligent manner and hit him. Due to the<\/p>\n
“‘,iepact; he sustained grievous injuries in the said<\/p>\n
VVMiaceident and later succumbed to the injuries. He<\/p>\n
u”was a retired K.E.B. Engineer and was drawingo a<\/p>\n
pension of Rs.4,562–00 p.m. on the date of his<\/p>\n

apportioned the negligence to the accident at 90% to
\nthe driver of the bus and 10% to the deceasedgn it
\ntook note of salary of the deceased at Rei\u00e9f\ufb01d\ufb01e\ufb02dx
\np.m., applied the multiplier “T” and awarded a sum _ ”
\nof Rs.2,52,000-OO under the
\ndependency after deducting 1\/3 tewards the gerg\u00e9eai”
\nexpenees of the deceased, taj’sum” Of “Rexi\ufb01;50d~O0
\nawarded under the head Qf loaehofdloye and affection
\nand consortium, another $ee7dt;Redi3e\u00a7QO~00 towards
\nthe funeral a?deQ0bseQhi?\u00a7: 8%\u00a7\u00a79\u00a7es;iiand. a sum of
\nRs.5,000~OO ;tewerdei the *:;a\u00a25\u00a7\u00a7;\ufb01e{:on earges. A
\nsum of _.–Rs  ‘–:::tideducted towards 10%
\nnegligence attribe\u00a7@d\u00b0toathe deceased and thus in<\/p>\n
all the Tribunai’ aeardediia sum of Rs.2,49,300wOO<\/p>\n

u\ufb02petitien tili the date of payment. Aggrieved by the<\/p>\n
said*hward} the elaimant preferred this appeal.<\/p>\n

=e’aubmite that no compensation is awarded under the<\/p>\n
.head less to the estate and the Tribunal erred in<\/p>\n
xattributing 13% of negligence to the deceased while<\/p>\n

9. Per contra, the learned counsel for the
\nrespondent\/Corporation supported the impugned Award
\nand also submitted that the Tribunal committed a
\nserious error in not deducting 50% of the xincone
\ntowards the personal expenses of the deceased; ;lI*Li.<\/p>\n
10. From the aforesaid materiel, indie gieard
\nthat deceased Sri. T.N.Sr:i.r1ivaean
\nat the time of the accident. V”~H\u00e9 Vwasf a _#?\u00a3iredhi
\nK.E.B. Engineer and was idrawing2″a:deension of
\nRs.4,562–GG p.m. as on the date 9% the accident. He
\nsuccumbed to theV’injurieV:is” accident.<\/p>\n
Though  justified in hoiding
\nthat the. deceased; wean also contributed to the<\/p>\n
accident and therefore eeportioned 10% negligence to<\/p>\n
‘”the deceesed and eiso in not awarding Rs.10,000~0O<\/p>\n
itowards*ioss to the estate, the Award de not call<\/p>\n
for interference because, in the first place, the<\/p>\n
‘Tribune; has taken the entire income of the deceased<\/p>\n
d”‘at”Rs-4,5GG~G0 p.m. for the purpose of calculating<\/p>\n
hthe loss ef dependency. when the claimant and her<\/p>\n
\u00bb husband i.e., the deceased are only two persons,<\/p>\n
3″normally 50% has to be deducted towards the personal<\/p>\n
expenses, which the Tribunal has not done. The<\/p>\n
