ARJUN\n\nDATE OF JUDGMENT: 08\/01\/2008\n\nBENCH:\nTarun Chatterjee &amp; Dalveer Bhandari\n\nJUDGMENT:\n<\/pre>\n<p>JUDGMENT<\/p>\n<p>O R D E R<br \/>\n[Arising out of SLP [C] No. 20598 of 2006]<br \/>\nTARUN CHATTERJEE,J.\n<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tThis order is restricted to an order dated 31st of July,<br \/>\n2006 passed by a learned Judge of the High Court at<br \/>\nNew Delhi in CRP No. 288 of 2005. We make it clear that<br \/>\nthe learned counsel appearing for the appellant did not<br \/>\npress the appeal which has also been filed against the<br \/>\norder dated 31st of July, 2006 in CRP No. 362 of 2004<br \/>\nand therefore, this appeal stands dismissed in so far as<br \/>\nregards the order dated 31st of July, 2006 in CRP No. 362<br \/>\nof 2004.  The impugned order dated 31st of July, 2006 in<br \/>\nCRP No. 288 of 2005 runs as under: &#8211;\n<\/p>\n<p>Notice.\n<\/p>\n<p>Notice accepted by Mr. Anupam Srivastava on<br \/>\nbehalf of the respondent.  It was pointed out<br \/>\nby both the learned counsel that leave to<br \/>\ndefend has already been granted.  The points<br \/>\nraised in this petition have already been<br \/>\nraised in the written statement.  The learned<br \/>\nJudge will consider those objections while<br \/>\ndisposing of the matter.  With these<br \/>\nobservations, the petition is disposed of  \t<\/p>\n<p>3.\tHaving heard the learned counsel for the parties<br \/>\nand after going through the impugned order as well as the<br \/>\norder of the trial Court rejecting the application filed under<br \/>\nOrder 7 Rule 11 of the CPC, we are of the view that the<br \/>\norder impugned in this appeal was passed by the High<br \/>\nCourt without applying its mind and without passing a<br \/>\nreasoned and speaking order. The High Court, in the<br \/>\nimpugned order, had only referred that the points raised<br \/>\nin the petition under Order 7 Rule 11 of the CPC shall be<br \/>\ndecided at the time of disposing of the original suit. That<br \/>\nbeing the position, the impugned order cannot stand and<br \/>\naccordingly, the order dated 31st of July, 2006 in CRP No.<br \/>\n288 of 2005 is set aside and the CRP No. 288 of 2005 is<br \/>\nrestored to its original file. The High Court is requested to<br \/>\ndecide the Civil Revision case being CRP No. 288 of<br \/>\n2005 at an early date preferably within three months from<br \/>\nthe date of communication of this order. We make it clear<br \/>\nthat we have not gone into the merits of the order, which<br \/>\nwas challenged by the appellant before the High Court<br \/>\nrejecting the appellants application under Order 7 Rule<br \/>\n11 of the CPC.
