DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/05\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tlearned counsel for the parties.\n<\/p>\n<p>This<br \/>\n\tpetition is directed against the order of detention dated 24.11.2009<br \/>\n\tpassed by the respondent No.2 in<br \/>\n\texercise of powers conferred under Section 3(2) of the Gujarat<br \/>\n\tPrevention of Anti Social Activities Act, 1985 (for short &#8220;the<br \/>\n\tAct&#8221;) by detaining the detenue as a &#8220;dangerous person&#8221;<br \/>\n\tas defined under Section 2(c) of the Act.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the detenue submits that the order of detention impugned<br \/>\n\tin this petition deserves to be quashed and set aside and the ground<br \/>\n\tthat the registration of 3 offences by itself cannot bring the case<br \/>\n\tof the detenue within the purview of definition &#8220;dangerous<br \/>\n\tperson&#8221; under Section 2(c) of the Act.  Learned counsel for<br \/>\n\tthe detenue further submits that the illegal activity carried out as<br \/>\n\talleged cannot have any nexus or bearing with the maintenance of the<br \/>\n\tpublic order and at the most it can be said to be breach of law and<br \/>\n\torder.  Further, except statements of witnesses and  registration of<br \/>\n\tFIRs,  no other relevant or cogent material is available on record<br \/>\n\tconnecting the alleged anti-social activities of the detenue with<br \/>\n\tbreach of the public order.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the detenue, placing reliance on the decisions reported<br \/>\n\tin the cases of (i) Ranubhai Bhikhabhai Bharwad (Vekaria) v.<br \/>\n\tState of Gujarat reported in 2000(3) GLR 2696; (ii) Ashokbhai<br \/>\n\tJivraj @Jivabhai Solanki v. Police Commisioenr, Surat reported in<br \/>\n\t2000(1) GLH 393; and (iii) <a href=\"\/doc\/341889\/\">Mustakmiya Jabbarmiya Shaikh v.<br \/>\n\tM.M.Mehta,<\/a> reported in (1995)3 SCC 237, submitted that the case<br \/>\n\ton hand is squarely covered by the ratio laid down in the aforesaid<br \/>\n\tdecisions. Learned counsel for the detenue further submits that it<br \/>\n\tis not possible to hold in the facts of the present case that the<br \/>\n\tactivities of the detenue with reference to the criminal case\/s had<br \/>\n\taffected even tempo of the society, posing a threat to the very<br \/>\n\texistence of the normal and routine life of the people at large or<br \/>\n\tthat on the basis of the  criminal case\/s, the detenue had put the<br \/>\n\tentire social apparatus in disorder, making it difficult for whole<br \/>\n\tsystem to exist as a system governed by the rule of law by<br \/>\n\tdisturbing the public order.\n<\/p>\n<p>Learned<br \/>\n\tAGP for the respondent-State supported the detention order passed by<br \/>\n\tthe authority and submitted that the detenue is a dangerous person<br \/>\n\tand sufficient material and evidence was found during the course of<br \/>\n\tinvestigation, which was also supplied to the detenue, indicating<br \/>\n\tthat the detenue is in habit of indulging into activities as defined<br \/>\n\tunder Section 2(c) of the Act and considering the facts of the case,<br \/>\n\tthe detaining authority has rightly passed the order of detention<br \/>\n\tand the detention order deserves to be upheld by this Court.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and considering the facts and<br \/>\n\tcircumstances of the case, it appears that the subjective<br \/>\n\tsatisfaction arrived at by the detaining authority cannot be said to<br \/>\n\tbe legal, valid and in accordance with law inasmuch as the offences<br \/>\n\talleged in the FIR\/s cannot have any bearing on the public order<br \/>\n\tsince the law of the land i.e. Indian Penal Code and other relevant<br \/>\n\tpenal laws are sufficient enough to take care of the situation and<br \/>\n\tthat the allegations as have been levelled against the detenue<br \/>\n\tcannot be said to be germane for the purpose of bringing the detenue<br \/>\n\tas a dangerous person within the meaning of Section 2(c) of the Act<br \/>\n\tand, unless and until the material is there to make out a case that<br \/>\n\tthe person concerned has become a threat and a menace to the society<br \/>\n\tso as to disturb the whole tempo of the society and that the whole<br \/>\n\tsocial apparatus is in peril disturbing public order at the instance<br \/>\n\tof such person, it cannot be said that the detenue is a dangerous<br \/>\n\tperson within the meaning of Section 2(c) of the Act.  Except<br \/>\n\tgeneral statement, there is no material on record which shows that<br \/>\n\tthe detenue is acting in such a manner which is dangerous to the<br \/>\n\tpublic order.   In view of the ratio laid down by the Hon&#8217;ble<br \/>\n\tSupreme Court in the cases of (i) Ranubhai Bhikhabhai Bharwad<br \/>\n\t(Vekaria)(supra); (ii) Ashokbhai Jivraj @Jivabhai Solanki (supra);<br \/>\n\tand (iii) Mustakmiya Jabbarmiya<br \/>\n\tShaikh (supra), the Court is of the opinion that the<br \/>\n\tactivities of the detenue cannot be said to be dangerous to the<br \/>\n\tmaintenance of public order and at the most fall under the<br \/>\n\tmaintenance of &#8220;law and order&#8221;.\n<\/p>\n<p>In<br \/>\n\tview of the above, I am inclined to allow this petition because<br \/>\n\tsimplicitor registration of FIR\/s by itself cannot have any nexus<br \/>\n\twith the breach of maintenance of public order and the authority can<br \/>\n\ttake recourse under the Indian Penal Code and no other relevant or<br \/>\n\tcogent material exists for invoking powers under Section  3(2) of<br \/>\n\tthe Act.\n<\/p>\n<p>In<br \/>\n\tthe result, this Special Civil Application is allowed. The impugned<br \/>\n\torder dated 24.11.2009 of detention  passed by respondent No.2 is<br \/>\n\thereby quashed and set aside.  The detenue is ordered to be set at<br \/>\n\tliberty forthwith if not required in any other case.  Rule is made<br \/>\n\tabsolute accordingly. Direct service is permitted.\n<\/p>\n<p>(ANANT S.
