Justice M.SASIDHARAN NAMBIAR\n\n Dated :19\/03\/2010\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n          ===========================\n       CRL.M.C.No. 955 &amp; 959   OF 2010\n          ===========================\n\n     Dated this the 19th day of March,2010\n\n                     ORDER\n<\/pre>\n<p>    Petitioners  in  Crl.M.C.955\/2010  are  the<\/p>\n<p>accused   in   C.C.36\/2010.    Petitioners   in<\/p>\n<p>Crl.M.C.959\/2010   are     the    accused    in<\/p>\n<p>C.C.35\/2010, both on the file of Judicial First<\/p>\n<p>Class Magistrate&#8217;s Court-II, Attingal.   Second<\/p>\n<p>respondent in Crl.M.C.955\/2010 is the first<\/p>\n<p>petitioner in Crl.M.C.959\/2010.   Respondents 2<\/p>\n<p>and 3 in Crl.M.C.959\/2010 are petitioners 1 and<\/p>\n<p>4 in Crl.M.C.955\/2010.     Both cases are in<\/p>\n<p>respect of the same incident. One is the main<\/p>\n<p>case   and    the   other    its   countercase.<\/p>\n<p>Prosecution case in Crime 35\/2010 is that the<\/p>\n<p>petitioners    in    Crl.M.C.959\/2010    formed<\/p>\n<p>themselves into an unlawful assembly with the<\/p>\n<p>common object of causing hurt to respondents 2<\/p>\n<p>and 3 and in furtherance of the common object,<\/p>\n<p>Crl.M.C.955 &amp; 959 of 2010       2<\/p>\n<p>they committed rioting on 3.3.2009 at 2.30 p.m,        on<\/p>\n<p>the front varandha of tea shop           PP IV\/559 caused<\/p>\n<p>and hurt to second respondent by beating him on his<\/p>\n<p>face and kicking on his leg and also caused hurt to<\/p>\n<p>the third respondent, by beating him and they<\/p>\n<p>thereby committed offences under sections 143, 147,<\/p>\n<p>148, 149,            323 and 324 of Indian Penal Code.<\/p>\n<p>Prosecution          case   in  Crime  36\/2010  is   that<\/p>\n<p>petitioners         formed  themselves into  an  unlawful<\/p>\n<p>assembly       with the common object of causing hurt to<\/p>\n<p>second respondent and committed rioting on 3.3.2009<\/p>\n<p>at 2.30 p.m at Manjappara junction and caused hurt<\/p>\n<p>on       second       respondent and  thereby   committed<\/p>\n<p>offences under sections 143, 147,148,149,294(b),<\/p>\n<p>323 and 324 of Indian Penal Code.         These petitions<\/p>\n<p>are filed under section 482 of the Code of Criminal<\/p>\n<p>Procedure to quash the cognizance taken by the<\/p>\n<p>learned Magistrate on the respective final reports<\/p>\n<p>contending that the entire disputes in the main<\/p>\n<p>case and the counter case were amicably settled.<\/p>\n<pre>Crl.M.C.955 &amp; 959 of 2010       3\n\nThe affidavits filed by          respondents 2 and 3    in\n\nCrl.M.C.959\/2010 and the affidavit filed by            the\n\nsecond respondent in Crl.M.C.955\/2010 show            that\n\n<\/pre>\n<p>they have amicably settled all the disputes with<\/p>\n<p>the     respective       petitioners  and  they  have   no<\/p>\n<p>subsisting grievance against them           and therefore<\/p>\n<p>the case is to be quashed.\n<\/p>\n<p>      2.          Learned   counsel   appearing  for   the<\/p>\n<p>petitioners             and    second    respondent     in<\/p>\n<p>Crl.M.C.955\/2010 and petitioners and respondents 2<\/p>\n<p>and 3 in Crl.M.C.959\/2010 and the Public Prosecutor<\/p>\n<p>were heard.          The affidavits filed by respondents 2<\/p>\n<p>and 3 in Crl.M.C.959\/2010 and the affidavit of<\/p>\n<p>second      respondent     in  Crl.M.C.955\/2010  establish<\/p>\n<p>that       entire disputes with the petitioners were<\/p>\n<p>settled amicably.          Final reports taken cognizance<\/p>\n<p>establish        that      offences  alleged  against  the<\/p>\n<p>respective        petitioners   are  purely   personal  in<\/p>\n<p>nature      as       against  respondents  2   and  3   in<\/p>\n<p>Crl.M.C.959\/2010           and   second   respondent    in<\/p>\n<p>Crl.M.C.955 &amp; 959 of 2010       4<\/p>\n<p>Crl.M.C.955\/2010.          As held by the Apex Court in<\/p>\n<p><a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of Punjab<\/a> (2008(3) KLT<\/p>\n<p>19) when the offences are purely personal in nature<\/p>\n<p>and there is           amicable settlement of the disputes<\/p>\n<p>between the parties, it is not in the interest of<\/p>\n<p>justice to continue the prosecutions.<\/p>\n<p>      Petitions         are  allowed.
