Justice K.T.SANKARAN\n\n Dated :27\/01\/2011\n\n O R D E R\n                 K.T.SANKARAN, J.\n          ------------------------------\n               O.P(C).No.358 OF 2011\n          ------------------------------\n                       th\n      Dated this the 27  day of January, 2011\n\n\n\n\n                     JUDGMENT\n<\/pre>\n<p>    The first defendant in O.S.No.154 of 2009 on<\/p>\n<p>the file of the Court of the Munsiff of Thalassery<\/p>\n<p>challenges in this Original Petition the order<\/p>\n<p>passed by the learned Munsiff in I.A.No.911 of 2009<\/p>\n<p>and the judgment passed by the appellate court in<\/p>\n<p>appeal in CMA No.34 of 2009 Sub Court, Thalassery.<\/p>\n<p>The first respondent filed the suit for injunction<\/p>\n<p>in respect of a property having an extent of 67<\/p>\n<p>cents. The petitioner herein resisted the suit. The<\/p>\n<p>contention of the petitioner is that the petitioner<\/p>\n<p>trust obtained rights from three persons who are<\/p>\n<p>co-owners in respect of the property.   It is also<\/p>\n<p>contended that the plaintiff was also a signatory<\/p>\n<p>to the agreement agreeing to transfer the property<\/p>\n<p>to the first defendant.\n<\/p>\n<p><span class=\"hidden_text\">O.P(C).No.358 OF 2011     2<\/span><\/p>\n<p>    2. The courts below held that the property<\/p>\n<p>belongs to 25 co-owners and of whom only the three<\/p>\n<p>persons have transferred their rights in favour of<\/p>\n<p>the first defendant trust. The courts below also<\/p>\n<p>held that the disputes involved in the case could<\/p>\n<p>be considered only at the time of trial.        The<\/p>\n<p>courts below directed both parties to maintain the<\/p>\n<p>status quo.\n<\/p>\n<\/p>\n<p>    3. There is no dispute that the petitioner did<\/p>\n<p>not get the full rights from all the co-owners. The<\/p>\n<p>petitioner contended that a temple was constructed<\/p>\n<p>in  the   property   on getting possession of   the<\/p>\n<p>property.    According to the petitioner, now what<\/p>\n<p>remains is the &#8216;Prathistha Kalasam&#8217; and at that<\/p>\n<p>juncture, the first respondent filed the suit and<\/p>\n<p>obtained an interim order.\n<\/p>\n<\/p>\n<p>    4. I have carefully     gone through the order<\/p>\n<p>passed by the trial court and the judgment passed<\/p>\n<p>by the appellate court. The courts below considered<\/p>\n<p><span class=\"hidden_text\">O.P(C).No.358 OF 2011      3<\/span><\/p>\n<p>the relevant facts and held that it is necessary to<\/p>\n<p>maintain the status quo until further orders.     No<\/p>\n<p>grounds are made out for interference under Article<\/p>\n<p>227 of the Constitution of India.<\/p>\n<p>    5.   The   learned  counsel for  the  petitioner<\/p>\n<p>pointed   out    that  in  the  peculiar  facts  and<\/p>\n<p>circumstances of the case, there may be a direction<\/p>\n<p>to   the   trial   court to   dispose  of  the  suit<\/p>\n<p>expeditiously. I do not think it is necessary to<\/p>\n<p>issue   notice   to  the respondent  for  issuing  a<\/p>\n<p>direction that regard.
