Justice V.K.MOHANAN\n\n Dated :25\/03\/2010\n\n O R D E R\n                     V.K.MOHANAN, J.\n         --------------------------------------------------\n                  Crl.A.NO. 601 OF 2010\n         --------------------------------------------------\n          Dated this the 25th day of March, 2010\n\n                       J U D G M E N T\n<\/pre>\n<p>         By order dated 15.1.2010 in S.T.No.3379 of 2008,<\/p>\n<p>which is a case instituted upon the complaint preferred by<\/p>\n<p>the appellant for the offence punishable under Section 138<\/p>\n<p>of the Negotiable Instruments Act,              the accused was<\/p>\n<p>acquitted under Section 256(1) of the Cr.P.C.<\/p>\n<p>     2.  Learned counsel submitted that the cheque in<\/p>\n<p>question covers an amount of Rs.40,000\/- and there is no<\/p>\n<p>decision on merit. Learned counsel further submitted that<\/p>\n<p>a proper application was filed before the court below to<\/p>\n<p>condone the absence of the complainant as she was laid up<\/p>\n<p>due to severe fever.\n<\/p>\n<p>     3. From the impugned order, it can be seen that the<\/p>\n<p>learned Magistrate issued the order on the ground that in<\/p>\n<p>spite of the specific direction to the complainant to be<\/p>\n<p>present and to adduce oral evidence on the date of the<\/p>\n<p>impugned order, she has not turned up and no evidence<\/p>\n<p>CRA 601 OF 2010<\/p>\n<p>                            :-2-:\n<\/p>\n<p>was adduced.     But from the order, it appears that       no<\/p>\n<p>reason is assigned by the learned Magistrate to dismiss the<\/p>\n<p>petition filed by the complainant to excuse her absence.<\/p>\n<p>From the cause title, it appears that the case pertains to the<\/p>\n<p>year 2008 and it is also borne out from the records that the<\/p>\n<p>cheque in question covers an amount of Rs.40,000\/-. Under<\/p>\n<p>the above factual back ground, without assigning reason for<\/p>\n<p>rejecting the application of the complainant to excuse her<\/p>\n<p>absence, the order passed by the learned magistrate under<\/p>\n<p>Section 256(1) of Cr.P.C. appears to be not correct and the<\/p>\n<p>learned Magistrate ought to have granted one more<\/p>\n<p>opportunity to the complainant to prosecute the appeal. At<\/p>\n<p>the same time, it is also relevant to note that the<\/p>\n<p>complainant was absent in spite of the specific direction for<\/p>\n<p>her presence and the application for excusing the absence<\/p>\n<p>was not accompanied by any certificate showing the illness,<\/p>\n<p>if any. Under the above circumstances, I am of the view<\/p>\n<p>that this appeal can be disposed of on terms, which will be<\/p>\n<p>CRA 601 OF 2010<\/p>\n<p>                            :-3-:\n<\/p>\n<p>sufficient to meet the ends of justice.\n<\/p>\n<p>           In the result, this appeal is disposed of setting<\/p>\n<p>aside the order dated 15.1.2010 in S.T.No.3379 of 2008 of<\/p>\n<p>the Court of the Judicial Magistrate of First Class,<\/p>\n<p>Ottappalam on condition that the appellant\/complainant<\/p>\n<p>deposits a sum of Rs.1000\/- (Rupees One Thousand only) in<\/p>\n<p>the court below. Accordingly, the appellant\/ complainant is<\/p>\n<p>directed to appear before the court below on 27.4.2010 and<\/p>\n<p>the court below is directed to restore the complaint on file<\/p>\n<p>on satisfaction that the complainant has deposited a sum of<\/p>\n<p>Rs.1000\/- and to proceed with the complaint in accordance<\/p>\n<p>with law and procedure and to dispose of the same on<\/p>\n<p>merit.
