\n                                 in the scale of pay
\n                                 Rs.370-600.\n<\/p><\/blockquote>\n

2.   Subsequently, the petitioner was appointed, on<\/p>\n
advice by the PSC on regular basis in the scale of pay of<\/p>\n
Rs.330-515\/-. She retired from service on 31.5.2005.\n<\/p><\/blockquote>\n
3.   Claim of the petitioner relates to the counting of<\/p>\n
provisional service for her pensionary benefits. When<\/p>\n
she made a request in this regard,             same was<\/p>\n
recommended by the District Medical Officer as is<\/p>\n
evidenced by Ext.P4.     It was noted in Ext.P4 that an<\/p>\n
increment had been sanctioned to the petitioner with<\/p>\n
reference to her provisional service. Therefore, same<\/p>\n
may be reckoned for calculating pension. Accountant<\/p>\n
General raised an objection vide Ext.P5 on the premise<\/p>\n
that the provisional service rendered by the petitioner<\/p>\n
prior to regular service was in the higher scale and the<\/p>\n
period cannot be considered for granting increment on<\/p>\n
regular scale, since the provisional service was not in the<\/p>\n
post of identical time scale as that of regular post. It is<\/p>\n
further stated therein that the petitioner’s pay is seen<\/p>\n
fixed in the minimum of the scale of pay of Rs.330\/- and,<\/p>\n

therefore, her provisional service does not qualify for<\/p>\n
pensionery benefits. Ext.P5 has been challenged in this<\/p>\n
writ petition.\n<\/p>\n<\/p>\n
4.   In the counter affidavit filed by the respondents<\/p>\n
the same stand has been reiterated. It is also evident<\/p>\n
from the portion of the counter affidavit which has been<\/p>\n
extracted above, that the provisional service rendered<\/p>\n
by the petitioner was in the scale of pay of Rs.370-600\/-\/-<\/p>\n
whereas on appointment to regular service, petitioner’s<\/p>\n
scale of pay was Rs.330-515\/-. It is further stated that as<\/p>\n
per the Government decision No.2 to Rule 33 of Part-I of<\/p>\n
K.S.R (as it stood prior to its deletion with effect from<\/p>\n
1.10.1994) the following aspects must be satisfied:-<\/p>\n
     1.     Posts should carry the same or identical<\/p>\n
     scale of pay.<\/p><\/blockquote>\n
     2.     The    qualification    and   method    of<\/p>\n
     appointment should be the same and<\/p>\n
     3.     The post should fall in the same service<\/p>\n

5.   It is contended that therefore, the post in which<\/p>\n
service was rendered on a provisional basis and the post<\/p>\n
to which the petitioner was appointed on a regular basis<\/p>\n
should carry the same or identical scale of pay.<\/p>\n
Admittedly, the scale of pay in her provisional service<\/p>\n
was higher in the time scale and therefore, petitioner<\/p>\n
was not entitled to take into account her provisional<\/p>\n
service for reckoning her increment or the pensionery<\/p>\n
benefits.\n<\/p>\n<\/p>\n
6.   I heard learned counsel for the petitioner and the<\/p>\n
learned Government Pleader.\n<\/p>\n<\/p>\n
7.   There are two cases      in which the provisional<\/p>\n
service could be taken into account, for the purpose of<\/p>\n
reckoning increment. One is where provisional service<\/p>\n
is rendered in the same post as of regular service. Other<\/p>\n
is where it is rendered in the same category of posts.<\/p>\n
Learned Government Pleader vehemently submits that<\/p>\n
the explanation forming part of the Government decision<\/p>\n

\n                              5<\/span><\/p>\n
as regards “the category of posts”          suggests    that<\/p>\n
provisional service as well as regular service should be<\/p>\n
rendered in a post      on the same time scale of pay.<\/p>\n
Question is whether it is so.\n<\/p>\n<\/p>\n
8.    I am of the view that identity in the scales of pay<\/p>\n
in the context of Government decision No.2 to Rule 33<\/p>\n
as it stood at the relevant time, is really applicable in the<\/p>\n
case where the provisional service and the regular<\/p>\n
service are rendered in different posts, but which are<\/p>\n
claimed to be under the same category, where there is<\/p>\n
no identity of posts, then benefit of Government decision<\/p>\n
No.2 could be claimed only when both the posts are<\/p>\n
under the same time scale of pay. I am of the opinion<\/p>\n
that the conditions, which are required to be satisfied in<\/p>\n
relation to a case where provisional service and regular<\/p>\n
service are rendered in two different posts but claimed<\/p>\n
to be falling under the same category, is not required to<\/p>\n
be invoked or applied in a case where both the<\/p>\n
provisional service and regular service are rendered in<\/p>\n

the same post. In the present case, there is no dispute<\/p>\n
that the provisional service and regular service of the<\/p>\n
petitioner was in the same post of Junior Public Health<\/p>\n
Nurse (petitioner was appointed on regular basis as a<\/p>\n
lady Health Inspector which, according to the counsel for<\/p>\n
the petitioner, was later designated as Junior Public<\/p>\n
Health Nurse). There is no warrant or justification for<\/p>\n
denying the petitioner increment relatable to the<\/p>\n
provisional service rendered by her.<\/p>\n
9.    In the result, writ petition is allowed. Ext.P5 is set<\/p>\n
aside. Third respondent is directed to pass a revised<\/p>\n
order, taking into account the provisional service<\/p>\n
rendered by the petitioner for the purpose of           her<\/p>\n
pensionery benefits, within a period of three months<\/p>\n
from the date of receipt of a copy of this judgment.<\/p>\n
