Appellant was present through his rep.,<br \/>\nShri V.N.Raghupathy, while the respondents were represented by the<br \/>\nCPIO, Shri P.K. Jha, DGM.\n<\/p>\n<p>2.    Appellant&#8217;s RTI-application dated 03.04.2008 comprised the<br \/>\nfollowing request for information:-\n<\/p>\n<blockquote><p>     &#8220;As reported in Udayavani daily dated 01\/04\/08 I came to know<br \/>\n     that your company has issued Group Family Health Insurance<br \/>\n     Policy through Sampoorna Suraksha Health Insurance Scheme to<br \/>\n     Shree Kshethra Dharmasthala Rural Development Project<br \/>\n     (Agents) to over 60,000 families.\n<\/p><\/blockquote>\n<blockquote><p>     1. I request you to provide me a copy of the Agreement or<br \/>\n        Memorandum of Understanding that you have entered into<br \/>\n        with Shree Kshetra Dharmasthala Rural Development<br \/>\n        Programme \u23af Sampoorna Suraksha Health Insurance Project.\n<\/p><\/blockquote>\n<blockquote><p>     2. I also request you to provide me a copy of the policy with<br \/>\n        terms and conditions mentioned therein, including the names<br \/>\n        of the beneficiaries (insured), their age, sex, address and<br \/>\n        premium amount collected against each insured person or<br \/>\n        group of persons.&#8221;\n<\/p><\/blockquote>\n<p>3.    The CPIO, through his communication dated 13.05.2008, informed<br \/>\nappellant that the Oriental Insurance Company Ltd \u23af the respondents<br \/>\n\u23af were a Public Insurance Company transacting business on commercial<br \/>\nprinciples. Disclosing the requested information would violate the<br \/>\nclient confidentiality, which the public authority was expected to<br \/>\nsafeguard. Information was, therefore, declined by the CPIO citing<br \/>\nSections 8(1)(d) and 8(1)(e) of the RTI Act. Appellate Authority,<br \/>\nthrough his order dated 19.01.2009, upheld CPIO&#8217;s decision.<br \/>\nAT-31072009-34.doc<br \/>\n<span class=\"hidden_text\">                                                          Page 1 of 3<\/span>\n<\/p>\n<p> 4.    Appellant, in his second-appeal, has questioned the decision of<br \/>\nthe Appellate Authority on the ground that there was public interest in<br \/>\nthe disclosure of the above information. The Oriental Insurance<br \/>\nCompany had issued health policies to a huge number of families<br \/>\nidentified by the third-party, Shree Kshetra Dharmasthala Rural<br \/>\nDevelopment Programme, which collected certain fee in the form of<br \/>\npremium from the insured persons. It is the appellant&#8217;s contention that<br \/>\nthe information requested by him was vital in order to verify whether<br \/>\nthe third-party, Shree Kshetra Dharmasthala Rural Development<br \/>\nProgramme charged excessive amount as fee \/ premium from the<br \/>\ninsured. According to appellant, &#8220;the Oriental Insurance Company has<br \/>\nallowed the agent to charge a higher premium to the beneficiaries and<br \/>\ncollecting less than that per person from the agent&#8221;. He feels that<br \/>\nthere was a deal between the agent and the company in the form of the<br \/>\nMemorandum of Understanding in order to defraud the public. It is the<br \/>\nappellant&#8217;s contention that being a matter of public interest, the above<br \/>\nrequested information does not attract exemptions under Section<br \/>\n8(1)(d) or Section 8(1)(e) of the Act.\n<\/p>\n<p>Decision:\n<\/p>\n<p>5.    I find that appellant has resorted to surmises and conjectures in<br \/>\norder to make out a case for disclosure of the requested information in<br \/>\npublic interest. There is not an iota of verifiable evidence about<br \/>\nwhether there was any fraud and collusive action by the service<br \/>\nprovider and the third-party in collecting more than the required<br \/>\npremium from the insured as alleged by the appellant. No decision<br \/>\nabout collusion between the Oriental Insurance Company Ltd and Shree<br \/>\nKshetra Dharmasthala Rural Development Programme can be made on<br \/>\nthe basis of the submission which appellant has made.\n<\/p>\n<p>6.    Respondents have argued that this kind of request smacks of an<br \/>\nattempt to know the details of agreement between the third-party and<br \/>\nthe insurance company in order to undercut both and to take away their<br \/>\nbusiness to their rivals. Public interest is only a veil to cover the crass<br \/>\ncommercialism in this form of RTI-petitions.\n<\/p>\n<p>7.     The commercial entities such as the Oriental Insurance Company<br \/>\nis entitled to protect its commercial interests especially relating to the<br \/>\nagreements it enters into to promote its objectives, with third-parties.<br \/>\nAny disclosure of this variety of information including details of the<br \/>\npremiums \/ fee could be detrimental to the commercial interest and<br \/>\ncompetitive interest of the public authority and possibly also of the<br \/>\nAT-31072009-34.doc<br \/>\n<span class=\"hidden_text\">                                                                Page 2 of 3<\/span><br \/>\n third-party. This doubtless attracts Section 8(1)(d) of the RTI Act and<br \/>\ncannot be authorized to be disclosed.\n<\/p>\n<p>8.    Appeal fails. Closed.\n<\/p>\n<p>9.
