Justice V.RAMKUMAR\n\n Dated :20\/03\/2007\n\n O R D E R\n                            V.RAMKUMAR, J.\n\n                             ----------------------------\n\n                     Bail Application No. 1686\/2007\n\n                            -----------------------------\n\n                  Dated this  20th day of March, 2007\n\n\n                                  O R D E R\n<\/pre>\n<p>             The   petitioners,   who   are   accused   Nos.   1   to   11   in<\/p>\n<p>Crime   No.58\/2007   of   Kunnamangalam   Police   Station   for<\/p>\n<p>offences   punishable   under   Sections   143,   147,   148,   341,   324,<\/p>\n<p>308,   332   and   225(b)   IPC   read   with   Section   149   IPC   and   also<\/p>\n<p>under   Section   3(2)(e)   of   the   PDPP   Act,   seek   their   enlargement<\/p>\n<p>on bail.  The occurrence took place on 6.3.2007.  Accused Nos. 1<\/p>\n<p>and 2 were arrested on 6.3.2007 and   rest of the accused were<\/p>\n<p>arrested on 9.3.2007.\n<\/p>\n<p>      2.     The   learned   Public   Prosecutor   opposed   the<\/p>\n<p>application.\n<\/p>\n<p>      3.     The case of the prosecution is that   Sub Inspector of<\/p>\n<p>Police,   Kunnamangalam   along   with   his   police   party   were<\/p>\n<p>patrolling   within   the   limits   of   the   Police   Station   in   connection<\/p>\n<p>with the   harthal  sponsored  by UDF and when the  police party<\/p>\n<p>reached at a place  called 10th  mile, about 25  persons including<\/p>\n<p>the   petitioners   herein   formed   themselves   into   an   unlawful<\/p>\n<p>assembly and committed rioting armed with dangerous weapons<\/p>\n<p>and   deterred   the   police   party   from   discharging   their   official<\/p>\n<p>B.A.1686\/2007<\/p>\n<p><span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>duty.     They   also     pelted     stones   at   the   Sub   Inspector   and   his<\/p>\n<p>companions   and   damage   caused   to   the   police   jeep   was   of<\/p>\n<p>Rs.2,000\/-.\n<\/p>\n<p>      4.       Having   regard   to   the   nature   of   the     offences,   the<\/p>\n<p>duration   of   judicial   custody   of   the   petitioners   and   the   other<\/p>\n<p>circumstances of the case etc.,  I am inclined to grant bail to the<\/p>\n<p>petitioners, but from a future date.  Accordingly, the petitioners<\/p>\n<p>are  directed   to  be  released   on  bail   with   effect  from  28.3.2007,<\/p>\n<p>on each of them   executing a bond for Rs. 10,000\/- (Rupees ten<\/p>\n<p>thousand   only)   with   two   solvent   sureties   each   for   the   like<\/p>\n<p>amount to the satisfaction  of the  J.F.C.M,  Kunnamangalam and<\/p>\n<p>subject to the following conditions:\n<\/p>\n<blockquote><p>               (a).      The   petitioners   shall   report   before   the<\/p>\n<p>                  Investigating  Officer   between   9  a.m.  and  11<\/p>\n<p>                  a.m. on all Wednesdays.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>               (b).   The   petitioners   shall   make   themselves<\/p>\n<p>                  available   for   interrogation   as     and   when<\/p>\n<p>                  required   by   the   police   till   the   filing   of   the<\/p>\n<p>                  final report.<\/p><\/blockquote>\n<p>             (c).        The     petitioners   shall   not   influence   or<\/p>\n<p>                  intimidate   the   prosecution   witnesses   nor<\/p>\n<p>B.A.1686\/2007<\/p>\n<p><span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>                  shall   they     attempt   to   tamper   with   the<\/p>\n<p>                  evidence for the prosecution.\n<\/p>\n<p>               (d).     The   petitioners   shall   not   commit   any<\/p>\n<p>                  offence while on bail.\n<\/p>\n<p>        5.
