(J)\n\nCITATION:\n 1996 AIR  981\t\t  1996 SCC  (1) 669\n JT 1995 (9)   127\t  1995 SCALE  (6)764\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Notification under\t s.4(1) of  the Land Acquisition Act<br \/>\nwas published  on May  10,1962 acquiring  a total  extent of<br \/>\n62.5 acres  belonging to  the appellant for extension of the<br \/>\nSouth Eastern Railway Station. The award under s.11 was made<br \/>\non May\t13, 1965 determining the compensation @ Rs.250\/- per<br \/>\nacre. On  reference under  s.18 by  award and  decree  dated<br \/>\nDecember 8, 1971, the Court had enhanced the compensation to<br \/>\nRs.2,000\/- per\tacre. On  further  appeal  under  s.54,\t the<br \/>\nDivision Bench\tof the\tHigh Court  by judgment\t and  decree<br \/>\ndated September\t 29, 1984  further enhanced the compensation<br \/>\nto  Rs.7,000\/-\t per  acre.   Dissatisfied  therewith,\t the<br \/>\nappellant has  filed this appeal by special leave. The State<br \/>\ndid not file any appeal against the enhanced compensation.\n<\/p>\n<p>     Shri Joshi, learned counsel for the appellant contended<br \/>\nthat  the   appellant,\teven   before  the  acquisition\t was<br \/>\ninitiated, had offered the land @ Rs.4\/- per sq. yd. and the<br \/>\nDepartment had\tagreed and  proceeded with  the acquisition.<br \/>\nThe High  Court should\thave granted  compensation at Rs.4\/-<br \/>\nper sq.\t yd. It is also contended that the High Court having<br \/>\naccepted the  sale deeds,  item 1,  2 and  7 which served as<br \/>\ninstances  of  comparable  market  value,  they\t would\tform<br \/>\nreasonable basis to determine the compensation. But the High<br \/>\nCourt committed\t grievous  error  of  law  in  ignoring\t the<br \/>\nmaximum price  that were fetched in those sale deeds and the<br \/>\nHigh Court  ought to  have granted  maximum price determined<br \/>\nunder those  sale deeds. Having heard the learned counsel on<br \/>\nboth the  counts, we  think that there is no force in either<br \/>\ncontention.\n<\/p>\n<p>     So far  as the claim @ Rs.4\/- per sq. yd. is concerned,<br \/>\nit was\tonly an offer made by the appellant and there was no<br \/>\nconcluded  agreement   nor  at\t least\tacceptance   by\t the<br \/>\nDepartment to purchase the lands at that rate. The concerned<br \/>\nengineer had  written to the appellant to give his offer for<br \/>\nacquisition of\tthe land whereat he had quoted at Rs.4\/- per<br \/>\nsq. yd.\t There was  no\tacceptance  thereof.  However,\tthey<br \/>\nreferred the  matter to the Collector for acquisition. Under<br \/>\nthose circumstances, it remained to be at the stage of offer<br \/>\nwithout any  acceptance. It  cannot be\tsaid that there is a<br \/>\nconcluded agreement between the requisitioning authority and<br \/>\nthe appellant  to purchase  the lands  @ Rs.4\/-\t per sq. yd.<br \/>\nWith regard  to the  three sale deeds, it is true that there<br \/>\nis some\t typographical error  in item  2 with  regard to the<br \/>\nassessment of  the price  fetched therein. But one important<br \/>\nfactor that  cannot, under  any stretch\t of imagination,  be<br \/>\nlost right  of, is  that all  the lands\t including the\tland<br \/>\ncovered under  item 2  are situated  in green belt area. The<br \/>\nland in\t item 2\t is of an extent of 260 x 85 sq. ft. and the<br \/>\nconsideration referred\tto therein  was Rs.11,500\/-. Even at<br \/>\nthe time  of acquisition,  as per  the report  of  the\tLand<br \/>\nAcquisition Officer  in the award, there was no development,<br \/>\nthough the  lands are situated within the master plan of the<br \/>\nmunicipal limits.  Yet the lands remained to be agricultural<br \/>\nlands. It  is true that sanction was obtained for converting<br \/>\nthe lands  into non-agricultural  lands. It would be obvious<br \/>\nthat having  become aware  of the  proposal for acquisition,<br \/>\nthe permission\tfor conversion was obtained by the appellant<br \/>\nwith a\tview to inflate the market value. All the sale deeds<br \/>\nrelate to  small extents  of agricultural lands purchased on<br \/>\nsquare feet  basis. They  would offer no reasonable basis to<br \/>\nfurther enhance\t the compensation though they fetched higher<br \/>\nmarket\tvalue\tworked\tout  at\t Rs.33,000\/-  per  acre.  No<br \/>\nreasonable and\tprudent purchaser  would offer\tto  purchase<br \/>\nthis vast  extent of  land at  that rate.  Except  obtaining<br \/>\nsanction for  conversion no  further action  to develop\t the<br \/>\nlands was taken.\n<\/p>\n<p>     Considered from  these angles the High Court having had<br \/>\nthe advantage of considering the entire evidence, determined<br \/>\nthe compensation  at Rs.7,000\/-\t per acre.  We do  not think<br \/>\nthat  we   would  be   justified  to   further\tenhance\t the<br \/>\ncompensation.
