4. Brief facts of the case are:\n<\/p>\n

That on 1443-01, when the claimant was
\nproceeding by riding Kinetic Safari bearing registration
\nNo.KA–19–K–514 towards his house in Arya Samaj road<\/p>\n
from Nandikoor Clinical Laboratory of  a<\/p>\n
motor Cycle bearing registration No. <\/p>\n
came from opposite direction in pa rash”‘an_d “n.eg].igen”txg <\/p>\n
manner and dashed against”A:4his”cmotor’-cycIe[‘ic’—-.As,i_:a<\/p>\n
result, the claimant fell ‘dowii and sustaivneidv–..injuriesV..L’<\/p>\n
Hence, he \ufb01led a;__c1aim__..petitio.n ‘Eoeforeg  MACT,
\nMangalore, seekmgif@mp\u00a2a;iati\u00a2rt[o;are Rs.2,00,000\/–.
\nT he Tribunaiiroy  and award has

‘  –._As”th’ere is no dispute regarding occurrence of<\/p>\n
“accident;’jnegligence and liability of the insurer of the<\/p>\n
offending Vehicle, the oniy point that remains for my<\/p>\n
” t.Vco”nsideration in the appeal is:<\/p>\n
Whether the quantum of
\ncompensation awarded by the Tribunal is<\/p>\n
just and proper or does it call for
\nenhancement?\n<\/p>\n
6. After hearing the learned Counsei for the “parties<\/p>\n
and perusing the award of the Tribunai. “‘the<\/p>\n
view that the compensation awarded ‘oy__ti:.e  <\/p>\n
not just and proper, it is on  side’ arid_t.he’refore it.<\/p>\n
it is deserved to be enhanced”.\n<\/p>\n
7. The claimant has  hfoiiovxvinfig injuries:

\npois\u00e9terioit  i’igaLrnent and multiple<\/p>\n
   and elbow joint
\n him are evident from the<\/p>\n

  —  disability certi\ufb01cate — Ex.P.11.<\/p>\n
~-siimmary — EX.P.12, Certi\ufb01cate issued from<\/p>\n
 Hospital ~– EX.P.13, case sheet — Ex.P.14 and<\/p>\n
 _ psuppoirted by oral evidence of the claimant and two<\/p>\n
Vdotctors examined as P.Ws.1, 2 and 3 respectively.<\/p>\n

\nClaimant was treated as inpatient for a period of 16
\ndays in Athena Hospital, Mangalore.
\nP.W.2 – Dr.Sridhar Shetty, has stated in his
\nevidence that he treated the claimant for the ligament<\/p>\n
injury to left knee joint in Athena Hospital… <\/p>\n
flexion is 85%. He assessed the disabilitjjllorii=t3’I”\u00a72le?j45}”‘ <\/p>\n
and on examination he fc~iind;’\u00ab \ufb01knee\u00ab .ls’ti_ffness “is 7<\/p>\n
persisting and he has stifjfnessti\u00e9of <\/p>\n
In his view, he has got  functional disability to
\nleft knee and it ma}\/The 1.0″\/o afterusorne time.
\nP.W.3 is running a  Claimant<\/p>\n
was  as  ‘LabQratorf_VV Assistant.\n<\/p>\n
8. ‘Considerir1’g’i_thex”nature of injuries, Rs.20,000\/–<\/p>\n
awarded 4’b5t_:Vt}’1ve.v”Ti9ibti”r:1aI towards pain and suffering is<\/p>\n
 on lower sidemand it is deserved to be enhanced by<\/p>\n
  anetiie:,%Vtie’ie5 ,eo00\/– and 1 award Rs.25,000\/– under this<\/p>\n

 9. ”  Rs.22,000\/– awarded by the Tribunal towards<\/p>\n
 vrriedieal expenses is as per medical bills produced by<\/p>\n

the claimant for Rs.2l,825\/-, the same is just and<\/p>\n
proper and therefore, it does not call for enhancement.<\/p>\n
10. Claimant was treated as inpatient for 16 days in
\nAthena Hospital and A.J. Hospital, Mangalore.<\/p>\n
Considering the same, Rs.5,000\/- awarded’V”-lofy:.V”‘the<\/p>\n
Tribunal towards incidental expenses’ {such ‘ jas<\/p>\n
conveyance, nourishment and attendant~:’ch”arges”Vis “on 7.<\/p>\n

11. Ciaimant has salary of<\/p>\n

\nLaboratory”., of  The Tribunal considering the<\/p>\n
 considering the period of treatment as three<\/p>\n
 awarded Rs.6,000\/- towards loss of<\/p>\n
 ir1comev’Vltidu’ring laid up periodrthe same is just and<\/p>\n
proper and there is no scope for enhancement .<\/p>\n
  Claimant even after sustaining injury has<\/p>\n
 continued his empioyment in the Laboratory of P.W.3<\/p>\n

and there is no loss of employment. Therefore, he is
\nnot entitled for compensation towards loss of future
\nincome. Nevertheless, he has to bear with the disability<\/p>\n
stated by the doctor and certain amount of discornfort<\/p>\n
and unhappiness, which he has to undergomfo:t’\u00bbV.’t15:1,C: <\/p>\n

 lexjtent stated herein above. The claimant is entitled for<\/p>\n
