PARWEEN KUMAR RAI, SON FO DINESHWAR RAI\n    ALL RESIDENT OF VILLAGE SAKARPURA, POLICE STATION HASSANPUR,\n    DISTRICT SAMASTIPUR\n    ................................................................................PETITIONERS\n                                 VERSUS\n                           THE STATE OF BIHAR\n                                 *********\n<\/pre>\n<p>2      28\/07\/2011              Heard Counsel for the petitioner and the<\/p>\n<p>                    A.P.P. appearing on behalf of the State.<\/p>\n<p>                               This application has been filed against the<\/p>\n<p>                    order dated 22.07.2008 passed in Hassanpur Police<\/p>\n<p>                    Station Case No. 18 of 2008 (Trial No. 2465 of 2008) by<\/p>\n<p>                    which the Judicial Magistrate, 1st Class, Rosera,<\/p>\n<p>                    Samastipur has taken cognizance for the offences<\/p>\n<p>                    alleged to have been committed under Sections 341,<\/p>\n<p>                    323, 342, 452, 307, 380, 504 and 34 of the Indian<\/p>\n<p>                    Penal Code.\n<\/p>\n<p>                               Learned Counsel for the petitioner submits<\/p>\n<p>                    that the petitioners have been implicated in this case<\/p>\n<p>                    due to civil dispute between the parties. It is submitted<\/p>\n<p>                    that the allegation is that petitioners threw stones and<\/p>\n<p>                    assaulted with a lathi, injuring the informant and his<\/p>\n<p>                    family members. The nature of the injury has been<\/p>\n<p>                    described as simple inflicted by hard blunt substance.<\/p>\n<p>                               Prima facie, the Court below has found that<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>        the allegation under Section 307 and other allied<\/p>\n<p>        sections of the Indian Penal Code are made out against<\/p>\n<p>        the petitioners.\n<\/p>\n<p>                    For the reason that it would delay the matter<\/p>\n<p>        by issuing notice to the informant as this matter would<\/p>\n<p>        require that other side should be heard, this Court is<\/p>\n<p>        disposing of this application with the observation that<\/p>\n<p>        on perusal of the First Information Report and the<\/p>\n<p>        injury report, it does not appear that a prima facie case<\/p>\n<p>        is made out under Section 307 of the Indian Penal<\/p>\n<p>        Code.\n<\/p>\n<p>                    This order may be brought to the notice of<\/p>\n<p>        the Court below by the petitioner at the stage of framing<\/p>\n<p>        of the charges. At that stage, the informant would also<\/p>\n<p>        get an opportunity to be heard.
