V  ll\ufb01iclcording to the petitioner, the land in Sy.<\/p>\n
 No.77 -nieasuring 4 acres 6 guritas of Salagar Basantpur<\/p>\n
it yil-lauge in Chincholi taluk, Gulbarga district was known<\/p>\n
 V\u00bb  Gosai Hittal land and also as Gavi kolla. According<\/p>\n
to him. the 5″‘ respondent by name Prabhushetty<\/p>\n
. 4 .\n<\/p>\n
husband of Smt. Shashikala was a Member of the Land<\/p>\n
Tribunal, Chinehoii and he was a very in\ufb02uential person<\/p>\n
in the said village. By coliuding with <\/p>\n
officials. entries in the record or rights ‘Caxmer’..to di:\u00bbef V’<\/p>\n
mutated in his name as a tenantvin respeet~:’of,the above”.<\/p>\n
said land. Said Prabhushetty  never  .oulti\\ia.t:ion”–..L<\/p>\n

 endorsement dated 25.5.2007 at<\/p>\n
i\ufb01vindicates that occupancy right was sought<\/p>\n
 again’st__done Mr. Narjangiri s\/ o Baldeva Giri pertaining<\/p>\n
 No.77 measuring 4 acres 6 guntas. it is noted in<\/p>\n
  proceedings that as the applicant was one of the<\/p>\n
Members of the Tribunal. he did not participate in the<\/p>\n
.5.\n<\/p>\n
proceedings and the records before the Tribunal<\/p>\n
indicate that he was in cultivation of the iandsiiace<\/p>\n
many years. The landlord and the tenant were”:a’bsjent,<\/p>\n
T herefore. occupancy rights were granted.   it<\/p>\n

ti1e"hsarneV'Vlizi1lage from which Prabhushetty hails and so<\/p>\n
 also *~ place where the property in question is<\/p>\n
 Sitn'ated. The documents produced by the petitioner<\/p>\n
  along with the petition at Annexures A & 13 indicate one<\/p>\n
Narjalngiri was the pattadar of the land and<\/p>\n
. 6 .\n<\/p>\n
Prabhushetty was in possession and enjoyment of the<\/p>\n
land right from 1968 onwards. Subsequent to the death<\/p>\n
of Prabhushetty his wife Shashikala is in <\/p>\n
and enjoyment of the said land.\n<\/p>\n

property. Except one single person, no other person is<\/p>\n

Even otherwise, there is no material establishingthe
\nexistence of either pathway or a proper road -usrgxxici<\/p>\n
