Prabhakar, Adv.\n<\/p>\n<p>                                    &#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>3.   13.09.2011             Heard learned counsel for the petitioners<\/p>\n<p>                  and the State.\n<\/p>\n<p>                            The petitioners are aggrieved by the order<\/p>\n<p>                  dated 2.7.2009 by which the benefit of A.C.P granted<\/p>\n<p>                  on 30.11.2007 and 5.1.2009 has been amended<\/p>\n<p>                  reducing the pay scale. Consequent directions have<\/p>\n<p>                  also been given for recovery of payments made under<\/p>\n<p>                  the old scale.\n<\/p>\n<p>                            Learned counsel for the petitioners make a<\/p>\n<p>                  limited submission that the order having adverse<\/p>\n<p>                  civil consequences not only by reducing the pay<\/p>\n<p>                  scale but also when it directs recovery has been<\/p>\n<p>                  issued in violation of the principles of natural justice<\/p>\n<p>                  without a show cause notice prior to the same as<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>specifically asserted in Paragraph-13 of the writ<\/p>\n<p>application.\n<\/p>\n<p>          Counsel for the State sought to persuade<\/p>\n<p>the Court to go into the merits of the reasons for the<\/p>\n<p>correction but is unable to demonstrate from the two<\/p>\n<p>counter affidavits filed that a show cause notice was<\/p>\n<p>given to the petitioners and their point of view<\/p>\n<p>considered only whereafter the impugned order has<\/p>\n<p>been passed.\n<\/p>\n<p>          The Court in exercise of its powers of<\/p>\n<p>judicial review under Article 226 of the Constitution<\/p>\n<p>of India is not so much concerned with the merits of<\/p>\n<p>the order, but is primarily concerned with the<\/p>\n<p>decision making process.       Any order adverse to a<\/p>\n<p>person affecting his pay scale and directing recovery<\/p>\n<p>cannot be passed in violation of the principles of<\/p>\n<p>natural justice, behind their back, without an<\/p>\n<p>opportunity to defend. Such order on the face of it is<\/p>\n<p>arbitrary and prejudice is not required to be<\/p>\n<p>demonstrated.\n<\/p>\n<p>        The Supreme Court in (1994) 6 SCC 154<\/p>\n<p><a href=\"\/doc\/38788643\/\">(Bhagwan       Shukla   v.   Union   of   India)<\/a>   held   at<\/p>\n<p>Paragraph-3 as follows:-\n<\/p>\n<blockquote><p>                  &#8220;3.   &#8230;&#8230;&#8230;The       appellant    has<br \/>\n               obviously been visited with civil<br \/>\n               consequences but he had been<br \/>\n               granted no opportunity to show cause<br \/>\n               against the reduction of his basic pay.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                             3<\/span><\/p>\n<blockquote><p>                       He was not even put on notice before<br \/>\n                       his pay was reduced by the<br \/>\n                       department and the order came to be<br \/>\n                       made behind his back without<br \/>\n                       following any procedure known to law.<br \/>\n                       There has, thus, been a flagrant<br \/>\n                       violation of the principles of natural<br \/>\n                       justice and the appellant has been<br \/>\n                       made to suffer huge financial loss<br \/>\n                       without being heard. Fair play in<br \/>\n                       action warrants that no such order<br \/>\n                       which has the effect of an employee<br \/>\n                       suffering civil consequences should be<br \/>\n                       passed without putting the (sic<br \/>\n                       employee) concerned to notice and<br \/>\n                       giving him a hearing in the<br \/>\n                       matter&#8230;&#8230;&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                    Only for that reason the impugned order<\/p>\n<p>           dated 2.7.2009 is set aside but without prejudice to<\/p>\n<p>           the rights of the respondents to proceed afresh in<\/p>\n<p>           accordance with law, if so advised.\n<\/p><\/blockquote>\n<blockquote><p>                    The writ application stands allowed.\n<\/p><\/blockquote>\n<pre>P.
