The petitioner submits that it is a_   ‘A V’<\/p>\n

\nblack pepper in terms’   Handbook of
\nProcedures 2oo2,\u00bb2oo’fd\u00a7~e “1ie=:vvssa\u00a7:@;–::11e\u00abs::cee”eras granted by the
\nJoint Director Geixeral  Bangalore. The norms
\nunder SiON-E6′ for of pepper oleoresin there
\nshall}   o\ufb02siack pepper. It is submitted that
\nthe   coo d\u00a7uons under SION-E6 he \ufb01nds some
\n  oepper oil and the petitioner unit \ufb01nds<\/p>\n
 in oomp\ufb01mg the norms in import and export of black<\/p>\n
dd    ~.i’\u00bb\u00a3”_.s”A.\u00aboil and it was found that some sim\ufb02ar units<\/p>\n
  tailing within the jurisdiction of Joint Director<\/p>\n
of of Foreigl Trade, Cochin found ad hoc norms of<\/p>\n
peoper of non Sri Lankan origin as approved by the Advance<\/p>\n

\nLicensing Committee with the import of 8.45 kgs. of black<\/p>\n
pepper of non Sri Lanka origin and he has furnished the<\/p>\n
advance licences Committee Meeting No.25\/O4 <\/p>\n
23\/3\/2003. He also 1’uI’n;ished the name of said  <\/p>\n
Synthetic Industrial Chemicais Ltd., Kerala   ,  <\/p>\n
No. 10100092-333 dated 7\/6\/2002 and <\/p>\n
produced as Annexure-A, The petitioner <\/p>\n
that adhoc licence in para 4.7 of Han’ d””boo3gV of had
\nalso been issued to other    of Karala<\/p>\n
including the   Flavours 6; Extracts
\nLimited. Copy  \ufb01t Annexure-B.\n<\/p>\n

\nand one on 6\/12\/2005 to the Secretary,<\/p>\n
 of  and Industries, Government of India.<\/p>\n

  20\/12\/2005 rejected the request of the<\/p>\n
 stating that it is not possible to accede to the request<\/p>\n
of the petitioner for enhancement of quantity of import items.<\/p>\n

3. Against the said order, the petitioner   <\/p>\n
appeal to the Additional Secretary, Ministry’     it<\/p>\n
4\/2\/2006 as per Annexure~J under Sect.iorL_9:(5)z Sec\ufb01o\ufb01 <\/p>\n
of Foreign Trade (Development
\nmrsuant. to the appeal   been

rejected. Hence the petitioner has preferred this writ petition.\n<\/p>\n
4. On behalf of the respondents, learned counsel has \ufb01led<\/p>\n
statement of objections contending that the prayer <\/p>\n
petitioner is liable to be rejected on the gonad that  <\/p>\n
has obtained licence under’ SIGN-E6    V<\/p>\n
Declaration Scheme (SIDS), like the two  *-of<\/p>\n

he has not noticed any shortfall in doing business and he has<\/p>\n

perused the records.\n<\/p>\n
6. The learned    contended that\nsimilar bene\ufb01t     situated at Kerala\n<\/pre>\n
referred to above n 3 bene\ufb01t is arbitrary and
\nopposed to Artieie     of India. The second
\ncontentionv of  i\u00e9etitioner  the appeal \ufb01led by him was
\nnot   he prays for allowing the writ<\/p>\n
 as prayed ,__f<)1'-..u On the other hand, learned counsel for<\/p>\n

  gegortdvoistttboniaeion of the petitioner is that the appeal preferred<\/p>\n
   appellate authority has been rejected on the ground<\/p>\n
  does not lie to the appellate oommittee. It has been<\/p>\n
cotizintunicated by the letter dated 314\/ 2006 that what is<\/p>\n

\nimpugned in the appeal is not a statutory order passed under<\/p>\n
any provisions so as to invoke appeal remedy under Section 9(5)<\/p>\n
r\/w Section 15 of Foreign Trade (Development and Regulations)<\/p>\n
Act 1982. It is only a formal communication and it is<\/p>\n
statutory order. The petitioner was advised to  ~<\/p>\n
o\ufb01ice of DGF1′ or the Grievance ()oIx1111ittee..i7or     <\/p>\n
grievances. Therefore, the second    7f<\/p>\n
petitioner also cannot be accepted.<\/p>\n
8. In View of the above ,.-facts  the<\/p>\n
petitioner has  that his ciaiza for change
\nof export and    by the authorities is
\nopposecito Vi4__ofV’tiia ovcozistitutzion tor the reason that the
\ntwo  i\u00bb\u00a21e::\u00a2ao:o  and the petitioner are not under the
\n situated at Kerala namely, M\/s.\n<\/p>\n
 V  Chemicals Ltd., and Kancor Flavours as<\/p>\n
   ~ :iI_’;s:<Ai:1V.Vi,i " are under the Self Declaration Scheme Whereas<\/p>\n
  has obtained licences under SION~E6. Obtaining<\/p>\n
\u00a7;iI1Ci6I' one particular scheme and seeking bene\ufb01t of a<\/p>\n
ll<\/p>\n
differem scheme on the ground of arbitrariness cannot ._ be<\/p>\n
upheld and considered.\n<\/p>\n
9. If the petitioner can establish that  .<\/p>\n
the two units referred to above have also… ”  ‘” V<\/p>\n
licence and got the bene\ufb01t of changed expert a I_’1d”i.f<\/p>\n
then it is open for the petitioner to the $’a.n;;e~ <\/p>\n
the appropriate autilority in acco:’danee—-v;iit31’iaw. ‘<\/p>\n
