Justice P.N.RAVINDRAN\n\n Dated :15\/01\/2010\n\n O R D E R\n<\/pre>\n<p>                       P.N.RAVINDRAN, J.\n<\/p>\n<p>               &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n               W.P.(C) No.1375 of 2010 &#8211; V\n<\/p>\n<p>               &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n                 Dated 15th January, 2010<\/p>\n<p>                            Judgment<\/p>\n<p>     The petitioner is a stage carriage operator operating a<\/p>\n<p>stage    carriage    on      the     route      Arthunkal-Cherthala-<\/p>\n<p>Thavanakkadavu-Aroor Temple.          The timings of the service<\/p>\n<p>were settled way back on 22.3.2005. It is stated that due to<\/p>\n<p>change in circumstances, the petitioner has filed Ext.P1<\/p>\n<p>application dated 16.11.2009 before the Regional Transport<\/p>\n<p>Officer, Alappuzha who is also the Secretary of the Regional<\/p>\n<p>Transport Authority, Alappuzha seeking revision of timings.<\/p>\n<p>The grievance voiced by the petitioner in this writ petition is<\/p>\n<p>that though more than two months have passed after Ext.P1<\/p>\n<p>application was submitted, the Secretary, Regional Transport<\/p>\n<p>Authority, Alappuzha has not considered the said application<\/p>\n<p>and orders passed thereon. In this writ petition, the petitioner<\/p>\n<p>seeks a direction to the Secretary, Regional Transport<\/p>\n<p>Authority, Alappuzha to consider Ext.P1 application and pass<\/p>\n<p>orders thereon within a time limit to be fixed by this Court.<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.1375\/2010             2<\/span><\/p>\n<p>       2.     Sri.K.C.Santhosh Kumar,     the  learned    Senior<\/p>\n<p>Government Pleader appearing for the respondent submits that<\/p>\n<p>apart from merely alleging that Ext.P1 application dated<\/p>\n<p>16.11.2009 has been submitted before the respondent, the<\/p>\n<p>petitioner has not produced any evidence to show that Ext.P1<\/p>\n<p>has been received by the respondent. He submits that in such<\/p>\n<p>circumstances, the only direction that can be issued by this<\/p>\n<p>Court is to dispose of this writ petition with a direction to the<\/p>\n<p>respondent to consider Ext.P1 application if as on today it has<\/p>\n<p>been received and is pending with the respondent.<\/p>\n<p>       3. The learned Senior Government Pleader appearing for<\/p>\n<p>the respondent is right in his submission that the petitioner<\/p>\n<p>has not produced any material to show that Ext.P1 application<\/p>\n<p>has been actually received and is pending with the respondent.<\/p>\n<p>However, in the light of the submission made by the learned<\/p>\n<p>Senior Government Pleader that if as on today Ext.P1<\/p>\n<p>application has been received and is pending with the<\/p>\n<p>respondent, the respondent will consider the same and pass<\/p>\n<p>orders thereon, I dispose of this writ petition with a direction<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.1375\/2010              3<\/span><\/p>\n<p>to the Secretary, Regional Transport Authority, Alappuzha to<\/p>\n<p>consider      Ext.P1  application  and  pass   orders  thereon<\/p>\n<p>expeditiously and in any event within one month from the date<\/p>\n<p>on which the petitioner produces a certified copy of this<\/p>\n<p>judgment before him if as on today he has received the<\/p>\n<p>original of Ext.P1 application, the same is pending and has not<\/p>\n<p>been disposed of till date.
