SHAH\n\t\t\n\t\n\n \n\nDate\n: 05\/05\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.0.\tPresent<br \/>\nSpecial Civil Application under Article 227 of the Constitution of<br \/>\nIndia, arises out of the order passed by the learned Executing Court.<br \/>\nToday, when the present Special Civil Application  is taken up for<br \/>\nfurther hearing, Shri M.R. Bhatt, learned Senior Advocate for the petitioners has stated at<br \/>\nthe bar that the petitioner No.2 Shankerrao Ganpatrao Tarone is<br \/>\npersonally present in the Court and that he has assured the Court on<br \/>\nbehalf of the petitioners that the aforesaid cheques shall be<br \/>\nhonoured as and when same are presented in the Bank. Shri M.R. Bhatt,<br \/>\nlearned Senior Advocate for the petitioners has stated at the bar<br \/>\nthat the respective petitioners are aware of the consequence of<br \/>\nnon-honouring of the aforesaid cheques and that in case the aforesaid<br \/>\ncheque and \/ or any of the cheques are not honoured and \/ or encashed<br \/>\nthe execution proceedings against the petitioners to execute the<br \/>\njudgment and decree shall be proceeded further. Shri Raval, learned<br \/>\nadvocate for the respondent has stated at the bar that the partner of<br \/>\nthe respondent Shri Vallabhbhai Manekbhai Patel is personally present<br \/>\nin the Court and the aforesaid cheques have been handed over to him.\n<\/p>\n<p>3.0.\tIn<br \/>\nview of the above, present Special Civil Application  is disposed of<br \/>\nand it is ordered that on encashment of the aforesaid cheques,<br \/>\njudgment and decree passed by the learned trial Court for which<br \/>\nexecution proceedings have been initiated shall be satisfied and<br \/>\nthereafter there shall not be any claim of the respondent against the<br \/>\npetitioners in the aforesaid judgment and decree passed by the<br \/>\nlearned trial Court. On encashment of the aforesaid cheques,<br \/>\nrespondent shall submit an appropriate purshis before the learned<br \/>\nExecuting Court for disposal of the aforesaid Execution Petition in<br \/>\nquestion. As agreed by the learned advocates for the respective<br \/>\nparties under the instructions from their respective clients in case<br \/>\nany of the cheque is dishonoured in that case respondent shall be<br \/>\npermitted to proceed further with the execution proceedings and to<br \/>\nexecute the judgment and decree passed by the learned trial Court for<br \/>\nwhich execution proceedings have been filed.
