Advocate\n\nHon'ble Imtiyaz Murtaza,J.\n<\/pre>\n<p>Hon&#8217;ble Naheed Ara Moonis,J.\n<\/p>\n<p>Heard learned counsel for the petitioners and also learned Addl. Government<br \/>\nAdvocate.\n<\/p>\n<p>The argument substantially is that fraught relation emanating from<br \/>\nmatrimonial bickering escalated into launching of criminal proceeding vide<br \/>\nCase Crime No. 98 of 2009 under sections 498-A,504,506,323,307 I.P.C. and<br \/>\n3\/4 of D.P. Act, P.S. Mahila Thana, District Muzaffarnagar.\n<\/p>\n<p>Having considered the arguments advanced across the bar, we have a feeling<br \/>\nthat Court owes a duty to the society to strain to the utmost to repair the<br \/>\nfrayed relations between the parties so that the wounded situation may be<br \/>\nhealed into a healthy rapprochement. The matter in hand also appears to be<br \/>\none of those cases in which reconciliation should be tried between the<br \/>\ndisputing parties.\n<\/p>\n<p>While referring the matter to Mediation Centre with the consent of the<br \/>\npetitioners, it is directed that the petitioners shall deposit a sum of Rs. 5000\/-<br \/>\nwith the Mediation Centre by way of Bank draft drawn in favour of daughter<br \/>\nof Opp party No. 4, victim wife. The Bank draft aforesaid, it is further<br \/>\ndirected, shall be handed over to daughter of Opp party No. 4 on her<br \/>\nappearing before the Mediation Centre on the date fixed. The amount<br \/>\naforesaid, it may be clarified, are meant to meet expenses to be incurred for<br \/>\nattending mediation sessions at Allahabad for the daughter of Opp party No. 4<br \/>\nand the person escorting her.\n<\/p>\n<p>The office upon deposit of the Bank draft shall issue notice within one week<br \/>\nto daughter of Opp party No. 4 i.e the wife calling upon her to appear in the<br \/>\nMediation Centre at Allahabad High Court on a date to be indicated in the<br \/>\nsaid notice stating therein that the Bank draft deposited by the petitioner shall<br \/>\nbe delivered to her whenever she appears in the Mediation centre on the date<br \/>\nfixed. The said notice shall be served upon the daughter of Opp party No. 4<br \/>\nthrough C.J.M concerned. It needs hardly be said that both the parties shall<br \/>\nappear either on the date fixed or on a future date as may be agreed before the<br \/>\nMediation Centre for reconciliation.\n<\/p>\n<p>The centre shall submit a report within one month from the date of parties<br \/>\nappearing before it for reconciliation. The case shall be listed in the month of<br \/>\nMarch, 2010 alongwith report of Mediation Centre.\n<\/p>\n<p>In the meanwhile, the arrest of the petitioners in the aforesaid case shall<br \/>\nremain stayed.\n<\/p>\n<p>It may made clear that in case, there occurs default by the petitioners either in<br \/>\n depositing the amount or in appearing before the Mediation Centre on the date<br \/>\nor dates fixed, the interim order shall cease to be operative and the Mediation<br \/>\nCentre shall immediately communicate with the office which in turn shall list<br \/>\nthe case within a week before the Bench concerned for passing appropriate<br \/>\norder in the matter.\n<\/p>\n<p>It may be clarified that the case will not be treated as tied up to this Bench<br \/>\nshall be listed before the appropriate Bench.\n<\/p>\n<p>Copy of this order will not be issued unless steps are taken.\n<\/p>\n<p>Order Date :- 11.1.2010<br \/>\nSalim\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Istakhar And Another vs State Of U.P.
