Justice M.SASIDHARAN NAMBIAR\n\n Dated :16\/06\/2008\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n            ===========================\n            W.P.(C) NO.6175     OF 2008\n            ===========================\n\n       Dated this the 16th day of June, 2008\n\n                     JUDGMENT\n<\/pre>\n<p>    Petitioner is the plaintiff in O.S.624\/2004 on<\/p>\n<p>the file of Additional Munsiff&#8217;s Court, Kollam.<\/p>\n<p>Respondents are the defendants.    Petitioner filed<\/p>\n<p>I.A.2916\/2004   an   application    for   temporary<\/p>\n<p>injunction under Order XXXIX Rule 1 of Code of<\/p>\n<p>Civil Procedure.   Under Ext.P1 order petition was<\/p>\n<p>dismissed.  Petitioner challenged that order before<\/p>\n<p>District Court, Kollam in C.M.A.5\/2005.     Learned<\/p>\n<p>Additional District Judge on reappreciation of the<\/p>\n<p>materials confirmed Ext.P1 order and dismissed the<\/p>\n<p>appeal.  It is challenged in this petition filed<\/p>\n<p>under Article 227 of the Constitution of India.<\/p>\n<p>    2.   Learned counsel appearing for petitioner<\/p>\n<p>was heard.\n<\/p>\n<p>    3.   Learned counsel appearing for petitioner<\/p>\n<p>argued that trial court and appellate court did not<\/p>\n<p>properly consider the claim of the petitioner with<\/p>\n<p><span class=\"hidden_text\">W.P.(C)6175\/2008             2<\/span><\/p>\n<p>regard to possession as well as      irreparable injury<\/p>\n<p>that will be caused and the balance of convenience<\/p>\n<p>and there is no material suppression of fact and in<\/p>\n<p>such circumstance       order of injunction should have<\/p>\n<p>been granted.\n<\/p>\n<p>     4.      On hearing the learned counsel, I do not<\/p>\n<p>find     any    illegality  or  irregularity or   other<\/p>\n<p>sufficient reason to interfere with Ext.P1 or P2<\/p>\n<p>orders.\n<\/p>\n<p>     5.       Trial court as well as appellate court<\/p>\n<p>found a prima facie case against petitioner and did<\/p>\n<p>not    grant    the   relief.    The  question  whether<\/p>\n<p>petitioner has been in possession of the plaint<\/p>\n<p>schedule property on the date of institution of the<\/p>\n<p>suit is to be       finally settled  on the evidence on<\/p>\n<p>record to be adduced in the suit.       The finding in<\/p>\n<p>Exts.P1 and P2 will not preclude the court to<\/p>\n<p>decide        whether petitioner is entitled to the<\/p>\n<p>decree      for   injunction  sought  for.    In   such<\/p>\n<p>circumstance, the petition is dismissed.
