\tMs. Archana Raval, learned. APP waives service of rule on behalf of
\n\trespondent- State.\n<\/p>\n
Heard
\n\tthe learned advocate for the applicant and learned APP for the
\n\trespondent ?  State.\n<\/p>\n
This
\n\tapplication is filed by the applicant under sec. 439 of Cr.P.C. for
\n\treleasing him on regular bail in connection with the offence
\n\tregistered vide CR No. I-92 of 2008 at Mehmadabad Police Station,
\n\tfor the offence punishable under sec. 306, 498-A and 114 of IPC.\n<\/p>\n
The
\n\tlearned advocate for the applicant has submitted that the applicant
\n\tis innocent and he is falsely involved in this case. He read papers
\n\tas well as the order passed by the trial court and prayed to release
\n\tthe applicants on regular bail.\n<\/p>\n
As
\n\tagainst this, learned APP Ms Archana Raval, has strongly opposed
\n\tthis application.\n<\/p>\n
I
\n\thave gone through the order passed by the trial court as well as the
\n\tpapers produced on the record of the case. Looking to the
\n\tallegations levelled against the applicant, I am inclined to release
\n\tapplicant on regular bail.\n<\/p>\n
Learned
\n\tadvocates for the parties do not press for reasoned order.\n<\/p>\n
Considering
\n\tthe facts and circumstances of the case, the present application is
\n\tallowed. The applicant ?  Natwarsinh Chatursinh Gohil is ordered to
\n\tbe released on regular bail in connection with CR No. I-92\/2008
\n\tregistered with Mehmadabad Police Station, Dist. Kheda, on his
\n\texecuting personal bond in the sum of Rs. 5000\/- (Rs. Five  Thousand
\n\tonly) with one surety of the like amount to the satisfaction of the
\n\ttrial court and subject to the  conditions that he shall;\n<\/p>\n
(a)\tnot
\ntake undue advantage of his liberty or abuse his \tliberty;\n<\/p>\n
(b)\tnot
\nact in a manner injurious to the  interest of \tthe  prosecution;\n<\/p>\n
(c
\n)\tsurrender his passport, if any, to the \tlower \tCourt  within a
\nweek;\n<\/p>\n
(d)\tnot
\nleave the State of Gujarat without the prior \tpermission of the
\nSessions Court concerned;\n<\/p>\n
(e)\tfurnish
\nthe present address of his residence to \tthe I.O., and also to the
\nCourt at the time of \texecution of the bond and shall not change the
\n\tresidence without prior permission of this \tCourt;\n<\/p>\n
(f)\tmaintain
\nlaw and order;\n<\/p>\n

\n  The authorities will release the applicant only if he is not
\nrequired in connection with any other offence for the time being.\n<\/p>\n
10.
\nIf breach of any of any of the above conditions is committed, the
\nSessions Judge concerned will be free to issue warrant or to take
\nappropriate action in the matter.\n<\/p>\n
11.\tBail
\nbond to be executed before the lower Court having jurisdiction to try
\nthe case.\n<\/p>\n
12.\tAt
\nthe trial, the trial court shall not be influenced by the
\nobservations of preliminary nature, qua the evidence at this stage,
\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n
13.\tRule
\nis made absolute accordingly. Direct Service permitted.\n<\/p>\n
