DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tMr.  learned APP, waives service of notice of Rule for respondent &#8211;<br \/>\n\tState.\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with first information report registered at<br \/>\n\tCR No.I 115\/2010 with Bhabhar Police Station, District Banaskantha<br \/>\n\tfor the offences punishable under Sections 498-A, 306, 506(2) and<br \/>\n\t114 etc. of the Indian Penal Code.\n<\/p>\n<p>Learned<br \/>\n\tcounsel appearing for the applicant submits that charge<br \/>\n\tsheet is filed.  It is further submitted that the FIR is<br \/>\n\tfiled after 7 months of alleged incident.  It is further submitted<br \/>\n\tthat the applicant is brother-in-law and allegations are general and<br \/>\n\tvague.  He further submits that the applicant has roots in the<br \/>\n\tsociety, will not flee from justice and will cooperate with the<br \/>\n\tinvestigation as and when called for. It is further submitted that<br \/>\n\tin view of the above, the applicant may be enlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP  for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused and punishment<br \/>\n\tprescribed for the alleged offences coupled with the fact that<br \/>\n\tcharge sheet is filed, without discussing the evidence in<br \/>\n\tdetail, at this stage, I am inclined to enlarge the applicant on<br \/>\n\tbail.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith first information report registered at C.R. No.I 115\/2010 with<br \/>\n\tBhabhar Police Station, District Banaskantha, on executing bond of<br \/>\n\tRs.5,000\/- (Rupees Five thousand only) with one surety of the like<br \/>\n\tamount to the satisfaction of the trial Court and subject to the<br \/>\n\tconditions that they shall;\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\ttheir passport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\ttheir presence at the concerned police station on the first Sunday<br \/>\n\tof every month between 10.00 a.m. and 3.00 p.m. for three months<br \/>\n\tonly;\n<\/p>\n<p>furnish<br \/>\n\tthe present address of residences to the I.O. and also to the Court<br \/>\n\tat the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<blockquote><p>\t\t\tThe<br \/>\n\t\t\tAuthorities will release the applicants only if they are not<br \/>\n\t\t\trequired in connection with any other offence for the time being.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\tIf breach of<br \/>\n\t\t\tany of the above conditions is committed, the Sessions Judge<br \/>\n\t\t\tconcerned will be free to issue warrant or take appropriate action<br \/>\n\t\t\tin the matter.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\tBail bond to<br \/>\n\t\t\tbe executed before the lower court having jurisdiction to try the<br \/>\n\t\t\tcase.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\tAt the<br \/>\n\t\t\ttrial, the trial court shall not be influenced by the observations<br \/>\n\t\t\tof preliminary nature, qua the evidence at this stage, made by<br \/>\n\t\t\tthis Court while enlarging the applicant on bail.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\tRule is made<br \/>\n\t\t\tabsolute to the aforesaid extent.
