Upon hearing the submissions made on behalf of the parties<br \/>\nand on perusal of the records, it appears that the High Court on the<br \/>\nfactual matrix came to a conclusion to the effect as below:\n<\/p>\n<p> &#8220;We are, therefore, on the view that the Family<br \/>\nCourt was right in holding that there was no<br \/>\nwrong established on the part of the Respondent<br \/>\nsubsequent to the decree of restitution of conjugal<br \/>\nrights which would disentitle him from seeking<br \/>\ndivorce under Section 13(1A)(ii) of the Act.&#8221;\n<\/p>\n<p>2. Having regard to the fact-situation of the matter, we do feel it<br \/>\nexpedient in the special facts of the matter under consideration not<br \/>\nto interfere with the findings of the High Court more specially<br \/>\nunder Article 136 of the Constitution and as such the matter does<br \/>\nnot warrant any interference.  The appeal is dismissed. All interim<br \/>\norders stand vacated.
